Building and Plumbing Amendment (Balcony Sprinkler Protection) Interim Regulations 2015

The Governor in Council makes the following Regulations:

Part 1—Preliminary

1Objectives

The objectives of these Regulations are—

(a)to amend the Building Regulations 2006 to provide for modifications to the BCA in relation to the sprinkler protection of covered balconies and the fire hazard properties of a material; and

(b)to make consequential amendments to the Plumbing Regulations 2008.

2Authorising provisions

These Regulations are made under sections 7, 9, 221ZZZV, 261 and 262 of, and Schedule 1 to, the Building Act 1993.

3Commencement

(1)These Regulations (except regulations 5 and 7) come into operation on the day on which they are made.

(2)Regulations 5 and 7 come into operation on 6 June 2016.

Part 2—Amendment of the Building Regulations 2006

4Regulations 123 and 124 inserted

After regulation 122 of the Building Regulations 2006[1] insert

'123   Determination that a material does not significantly increase the hazards of fire

The BCA Volume One applies as if, in deemed-to-satisfy provision C1.10—

(a)in paragraph (c)(xiii)(B) for "like; or" there were substituted "like."; and

(b)paragraph (c)(xiv) were omitted.

124Sprinkler protection of covered balconies

(1)The BCA Volume One applies as if, in Clause 5.6.13 of AS 2118.1 there were omitted "that exceed 6 m2 floor area and have a depth in excess of 2 m".

(2)The modification to AS 2118.1 in subregulation (1) does not apply in relation to a Class 5, 6, 7, 8 or 9b building.

(3)In this regulation AS 2118.1 means AS 2118.1—1999 Automatic fire sprinkler systems Part 1: General requirements, published 5 December 1999 as incorporated by the BCA Volume One from time to time.'.

5Revocation of regulations 123 and 124

Regulations 123 and 124 of the Building Regulations 2006 are revoked.

Part 3—Amendment of the Plumbing Regulations 2008

6New clause 3A in Schedule 2 inserted

After clause 3 in Schedule 2 to the Plumbing Regulations 2008[2] insert

'3A   Sprinkler protection for covered balconies

(1)The PCA is modified to the extent that AS 2118.1 is to be read as if there were substituted for Clause 5.7.10—

"5.7.10     Covered balconies

Covered balconies shall be sprinkler protected.".

(2)The modification to AS 2118.1 in subregulation (1) does not apply in relation to a Class 5, 6, 7, 8 or 9b building.

(3)In this regulation AS 2118.1 means AS 2118.1 Automatic fire sprinkler systems Part 1: General systems as issued, published or remade from time to time as incorporated by the PCA.'.

7Revocation of clause 3A in Schedule 2

Clause 3A in Schedule 2 to the Plumbing Regulations 2008 is revoked.

Part 4—Expiry

8Expiry

These Regulations expire on 7 June 2016.

Table of Applied, Adopted or Incorporated Matter

The following table of applied, adopted or incorporated matter is included in accordance with the requirements of regulation 5 of the Subordinate Legislation Regulations 2014.

In this table—

National Construction Code Series means the National Construction Code Series published by the Australian Building Codes Board as amended or remade from time to time;

BCA Volume One means Volume One of the National Construction Code Series including any variations or additions in the Appendix Victoria set out in the Appendices to that Volume; and

PCA means the Plumbing Code of Australia set out in Volume Three of the National Construction Code Series including any variations or additions in the Appendix Victoria set out in Appendix A of that Volume.
