County Court (Chapter I Circuit Fees, Expenses and Allowances Amendment) Rules 2015

A majority of the Judges of the County Court makes the following Rules:

1Object

The object of these Rules is to amend Chapter I of the Rules of the County Court—

(a)to provide for an increase in the following—

(i)the circuit fees in Schedule 1 to those Rules;

(ii)the witnesses' expenses and interpreters' allowances in Schedule 2 to those Rules; and

(b)to clarify the rate at which the circuit fees apply.

2Authorising provisions

These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers.

3Commencement

These Rules come into operation on 1 January 2016.

4Principal Rules

In these Rules, the County Court Civil Procedure Rules 2008[1] are called the Principal Rules.

5Definitions

In Rule 1.13(1) of the Principal Rules, for the definition of County Court costs scale substitute—

"County Court costs scale means—

(a)a fee, charge or amount that is 80 per cent of the applicable rate set out in Appendix A to Chapter I of the Rules of the Supreme Court; or

(b)in the case of a circuit fee, the amount set out in Schedule 1;".

6Schedule 1 substituted

For Schedule 1 to the Principal Rules substitute—

7Witnesses' expenses and interpreters' allowances

(1)In clause 1(1) of Schedule 2 to the Principal Rules—

(a)for "$180.00–$362.00" substitute

"$183.00–$367.00";

(b)for "$2248.00" substitute "$2279.00".

(2)In clause 1(2) of Schedule 2 to the Principal Rules, for "$375.00" substitute "$380.00".

(3)In clause 1(2) and (3) of Schedule 2 to the Principal Rules, for "$674.00" substitute "$683.00".

(4)In clause 1(3) of Schedule 2 to the Principal Rules, for "$111.00" substitute "$113.00".

(5)In clause 3(1) of Schedule 2 to the Principal Rules, for "$76.00" substitute "$77.00".

(6)In clause 3(1) and (2) of Schedule 2 to the Principal Rules—

(a)for "$53.00" substitute "$54.00";

(b)for "$326.00" substitute "$331.00".

(7)In clause 3(2) of Schedule 2 to the Principal Rules, for "$187.00" substitute "$190.00".
