Children's Services Amendment Regulations 2016

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Children's Services Regulations 2009 to require that an immunisation status certificate within the meaning of the Public Health and Wellbeing Act 2008 or details of an exemption under section 143C of that Act is to be kept as health information in the enrolment record of a child enrolled at a children's service.

2Authorising provision

These Regulations are made under section 56 of the Children's Services Act 1996.

3Commencement

These Regulations come into operation on 1 March 2016.

4Health information to be kept in child enrolment record

(1)In regulation 34(e) of the Children's Services Regulations 2009[1], for "the immunisation" substitute "unless paragraph (h) applies, the immunisation".

(2)In regulation 34(g) of the Children's Services Regulations 2009, for "effect." substitute "effect;".

(3)After regulation 34(g) of the Children's Services Regulations 2009 insert

"(h)in the case of a service (or any part of a service) specified in paragraph (b) of the definition of early childhood service as defined in section 3(1) of the Public Health and Wellbeing Act 2008

(i)an immunisation status certificate within the meaning of section 147 of that Act—

(A)that is issued in relation to the child; and

(B)that is provided under section 143B of that Act; or

(ii)details of any exemption in relation to the child under section 143C of that Act.".
