Residential Tenancies (Caravan Parks and Movable Dwellings Registration and Standards) Amendment Regulations 2016

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Residential Tenancies (Caravan Parks and Movable Dwellings Registration and Standards) Regulations 2010 to make minor amendments to the application of the National Construction Code Series.

2Authorising provisions

These Regulations are made under sections 514 and 516 of the Residential Tenancies Act 1997.

3Commencement

These Regulations come into operation on 1 May 2016.

4Principal Regulations

In these Regulations, the Residential Tenancies (Caravan Parks and Movable Dwellings Registration and Standards) Regulations 2010[1] are called the Principal Regulations.

5Unregistrable movable dwellings–Design and construction

(1)In clause 1(1)(a) in Part 1 of Schedule 3 to the Principal Regulations, for "P2.1(b)(xv)" substitute "P2.1.1(b)(xv)".

(2)In clause 1(1)(e) in Part 1 of Schedule 3 to the Principal Regulations, for "(iii) and (iv)" substitute "(iii), (iv) and (v)".

(3)In clause 1(1)(f) in Part 1 of Schedule 3 to the Principal Regulations omit "and Part 3.9.4".

The following table of applied, adopted or incorporated matter is included in accordance with the requirements of regulation 5 of the Subordinate Legislation Regulations 2014.

In this table—

BCA Volume Two means Volume Two of the National Construction Code Series including any Victoria additions set out in Appendix A of that Volume;

National Construction Code Series has the same meaning as in section 3(1) of the Building Act 1993;

Principal Regulations means the Residential Tenancies (Caravan Parks and Movable Dwellings Registration and Standards) Regulations 2010.
