Parliamentary Salaries and Superannuation (Provision of Motor Vehicles) Amendment Regulations 2016

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to


amend the Parliamentary Salaries and Superannuation (Provision of Motor Vehicles) Regulations 2013—

(a)to enable a member receiving an allowance in lieu of a motor vehicle to elect during the current term of Parliament (other than the period of 12 months immediately before the end of that term of Parliament) to be provided with a motor vehicle; and

(b)to allow a member to revoke an election to be provided with a motor vehicle in certain specified circumstances; and

(c)to provide that a person ceases to be provided with a motor vehicle if the person so elects; and

(d)to refer to the relevant Clerk rather than the relevant Presiding Officer; and

(e)to revoke spent regulations in relation to the provision of motor vehicles under the Parliamentary Salaries and Superannuation (Provision of Vehicles) Regulations 2006.

2Authorising provision

These Regulations are made under section 8A of the Parliamentary Salaries and Superannuation Act 1968.

3Commencement

These Regulations come into operation on 1 June 2016.

4Principal Regulations

In these Regulations, the Parliamentary Salaries and Superannuation (Provision of Motor Vehicles) Regulations 2013[1] are called the Principal Regulations.

5Definition

(1)For the heading to regulation 5 of the Principal Regulations substitute

"Definitions".

(2)In regulation 5 of the Principal Regulations insert the following definition—

"relevant Clerk means—

(a)in relation to a person who is a member of the Legislative Assembly, the Clerk of the Legislative Assembly; and

(b)in relation to a person who is a member of the Legislative Council, the Clerk of the Legislative Council;".

6Election in relation to a motor vehicle

(1)In regulation 6(1) of the Principal Regulations, for "Presiding Officer" substitute "Clerk".

(2)For regulation 6(2) of the Principal Regulations substitute

"(2)If a member has not made an election under subregulation (1), the member may elect in writing to the relevant Clerk during the current term of Parliament (other than the period of 12 months immediately before the end of that term of Parliament) to be provided with a motor vehicle.

(2A)A member may revoke in writing to the relevant Clerk an election made (or taken to be made) under subregulation (1) or (2) if the motor vehicle provided to the member is due to be replaced in accordance with the guidelines made under section 8B of the Parliamentary Salaries and Superannuation Act 1968.".

(3)In regulation 6(3) of the Principal Regulations—

(a)after "subregulation (1)" insert "or (2)";

(b)for "Presiding Officer that he or she" substitute "Clerk that the member".

(4)Regulation 6(4) and (5) of the Principal Regulations are revoked.

7Provision of a motor vehicle

(1)In regulation 7(1) of the Principal Regulations, for "his or her" (wherever occurring) substitute "the member's".

(2)After regulation 7(2)(b) of the Principal Regulations insert

"(ba)revoking under regulation 6(2A) an election made (or taken to be made) under regulation 6(1) or (2); or".

(3)In regulation 7(2)(c) of the Principal Regulations—

(a)for "Presiding Officer" substitute "Clerk";

(b)for "he or she" substitute "the member".
