Public Health and Wellbeing Amendment (Registered Premises) Regulations 2016
The Administrator of the State of Victoria as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Public Health and Wellbeing Regulations 2009 to prescribe a class of business in respect of which premises are to be exempt from the requirement that they be registered in accordance with Division 4 of Part 6 of the Public Health and Wellbeing Act 2008.
2Authorising provision
These Regulations are made under section 232 of the Public Health and Wellbeing Act 2008.
3Commencement
These Regulations come into operation on 16 June 2016.
4Definitions
In regulation 4 of the Public Health and Wellbeing Regulations 2009[1] insert the following definitions—
"Schedule 3 poison has the same meaning as in the Drugs, Poisons and Controlled Substances Act 1981;
Schedule 4 poison has the same meaning as in the Drugs, Poisons and Controlled Substances Act 1981;".
5Exempt registered premises
In regulation 15 of the Public Health and Wellbeing Regulations 2009, after paragraph (e) insert—
"(ea)the practice of a person registered under the Health Practitioner Regulation National Law to practise in the pharmacy profession (other than as a student) to the extent to which that practice involves the administration of a Schedule 3 poison
or a Schedule 4 poison in accordance with regulations made under the Drugs, Poisons and Controlled SubstancesAct 1981;".
