Retirement Villages Act 1986

Retirement Villages (Contractual Arrangements) Amendment Regulations 2016

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Retirement Villages (Contractual Arrangements) Regulations 2006 to—

(a)revoke the formula for calculation of the adjusted maintenance charge consequent upon the relocation of that formula to the Retirement Villages Act 1986 by the Consumer Acts and Other Acts Amendment Act 2016; and

(b)make a number of other related consequential amendments.

2Authorising provision

These Regulations are made under section 43 of the Retirement Villages Act 1986.

3Commencement

These Regulations come into operation on 1 July 2016.

4Principal Regulations

In these Regulations the Retirement Villages (Contractual Arrangements) Regulations 2006[1] are called the Principal Regulations.

5Regulation 1 amended

Regulation 1(d) of the Principal Regulations is revoked.

6Definitions

In regulation 4 of the Principal Regulations, the definitions of consumer price index number, existing retirement village, new retirement village and relevant financial year are revoked.

7Regulation 8A revoked

Regulation 8A of the Principal Regulations is revoked.

8Regulation 9 amended

(1)In regulation 9(1) of the Principal Regulations, omit ", other than regulation 8A,".

(2)Regulation 9(3) and (4) of the Principal Regulations are revoked.

(3)The notes at the foot of regulation 9 of the Principal Regulations are revoked.

9Schedule 4 amended

In clause 8 of Schedule 4 to the Principal Regulations—

(a)the definition of Australian Statistician is revoked; and

(b)in the definition of CPI, for "All Groups Consumer Price Index number (for Melbourne) published by the Australian Statistician" substitute "all groups consumer price index for Melbourne in original terms published by the Australian Bureau of Statistics".
