Victorian Civil and Administrative Tribunal Act 1998

Victorian Civil and Administrative Tribunal (Amendment No. 14) Rules 2016

The Rules Committee established by section 150 of the Victorian Civil and Administrative Tribunal Act 1998 makes the following Rules:

1Object

The object of these Rules is to amend the Victorian Civil and Administrative Tribunal Rules 2008 in relation to—

(a)the requirement to give written notice of a compulsory conference, mediation or hearing; and

(b)the delegation of functions of the Tribunal to the principal registrar; and

(c)the allocation of enabling enactments to various lists.

2Authorising provisions

These Rules are made under section 157 of the Victorian Civil and Administrative Tribunal Act 1998 and all other enabling powers.

3Commencement

These Rules come into operation on 1 July 2016.

4Principal Rules

In these Rules, the Victorian Civil and Administrative Tribunal Rules 2008[1] are called the Principal Rules.

5Notice of compulsory conference

In Rule 4.11 of the Principal Rules, for "The principal" substitute "Unless the Tribunal, by order, has specified the time and place of a compulsory conference, the principal".

6Notice of mediation

In Rule 4.12 of the Principal Rules, for "The principal" substitute "Unless the Tribunal, by order, has specified the time and place of a mediation, the principal".

7Notice of hearing

In Rule 4.13 of the Principal Rules, for "The principal" substitute "Unless the Tribunal, by order, has specified the time and place for the hearing of a proceeding, the principal".

8Principal registrar may exercise certain Tribunal functions

In Rule 9.01 of the Principal Rules, after "Lists in" insert "the Administrative Division (other than the Planning and Environment List),".

9Planning and Environment List

In clause 4 of Schedule 1 to the Principal Rules, for item 4.12A substitute

"4.12ARoad Management (General) Regulations 2016;".

10Review and Regulation List

In clause 5 of Schedule 1 to the Principal Rules—

(a)after item 5.6 insert

"5.6ABack to Work Act 2015;";

(b)for item 5.15 substitute

"5.15Co-operatives National Law Application Act 2013 and Part 7.3 of the Co-operatives National Law (Victoria);";

(c)item 5.43 is revoked;

(d)for item 5.57 substitute

"5.57Rail Safety (Local Operations) Act 2006, Part 7;

5.57ARail Safety National Law Application Act 2013;";

(e)after item 5.61 insert

"5.61ASentencing Act 1991, Part 8;".
