Environment Protection (Industrial Waste Resource) Amendment (Performance Standard) Interim Regulations 2016

The Governor in Council, on the recommendation of the Environment Protection Authority, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Environment Protection (Industrial Waste Resource) Regulations 2009 to change the performance standard for premises where non‑liquid prescribed industrial waste may be transported for destruction or deposit, required by the Authority for the approval of transport of that waste.

2Authorising provision

These Regulations are made under section 71 of the Environment Protection Act 1970.

3Commencement

(1)These Regulations (except regulation 6) come into operation on 21 December 2016.

(2)Regulation 6 comes into operation on 18 July 2017.

4Principal Regulations

In these Regulations, the Environment Protection (Industrial Waste Resource) Regulations 2009[1] are called the Principal Regulations.

5Transporting prescribed industrial waste

In regulation 26(3)(b) of the Principal Regulations, after "facility with" insert "equal to or".

6Revocation of amendment to regulation 26

In regulation 26(3)(b) of the Principal Regulations omit "equal to or".

7Expiry

These Regulations expire on 19 July 2017.
