Transport Accident Amendment Act 2016

The Parliament of Victoria enacts:

1Purpose

The main purpose of this Act is to amend the Transport Accident Act 1986 to repeal certain subsections of that Act inserted in 2013.

2Commencement

(1)Subject to subsections (2) and (3), this Act comes into operation on the day after the day on which it receives the Royal Assent.

(2)Sections 4 and 5 are taken to have commenced on 20 November 2013.

(3)Section 6 is taken to have commenced on 16 October 2013.

3Repeal of section 46A(2C) and (2D)

(1)In section 46A(2)(a)(i) of the Transport Accident Act 1986, for "(2A), (2B) and (2C)" substitute "(2A) and (2B)".

(2)Section 46A(2C) and (2D) of the Transport Accident Act 1986 are repealed.

(3)In section 46A(6A) of the Transport Accident Act 1986, for "subsections (2C) and (6)" substitute "subsection (6)".

4Section 61 amended

In section 61(2) of the Transport Accident Act 1986, for "or $1000" substitute ", $1000 or $32.50".

5Repeal of section 93(2A)

Section 93(2A) of the Transport Accident Act 1986 is repealed.

6Repeal of section 93(17A)

Section 93(17A) of the Transport Accident Act 1986 is repealed.

7New Division 8 of Part 11 inserted

After Division 7 of Part 11 of the Transport Accident Act 1986 insert—

"Division 8—Transport Accident Amendment Act 2016

227Definition

In this Division, amending Act means the Transport Accident Amendment Act 2016.

227AAmendment of section 61 (Indexation)

This Act, as amended by section 4 of the amending Act, applies to all claims, regardless of when the claim was made.

227BRepeal of section 93(2A)

This Act, as amended by section 5 of the amending Act, applies to all transport accidents, regardless of when the accident occurred.

227CRepeal of section 93(17A)

This Act, as amended by section 6 of the amending Act, applies to an application made on or after 16 October 2013—

(a)for a certificate under section 93(4)(c)(ii); or

(b)for leave under section 93(4)(d).".

8Repeal of amending Act

This Act is repealed on the first anniversary of the day on which all of its provisions have come into operation.

Note

The repeal of this amending Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
