Victorian Civil and Administrative Tribunal Act 1998

Victorian Civil and Administrative Tribunal (Amendment No. 16) Rules 2017

The Rules Committee established by section 150 of the Victorian Civil and Administrative Tribunal Act 1998 makes the following Rules:

1Object

The object of these Rules is to amend the Victorian Civil and Administrative Tribunal Rules 2008—

(a)to revoke a restriction on the principal registrar from performing certain Tribunal functions in relation to proceedings in the Planning and Environment List; and

(b)to insert an additional function of the Tribunal that may be performed by the principal registrar.

2Authorising provisions

These Rules are made under section 157 of the Victorian Civil and Administrative Tribunal Act 1998 and all other enabling powers.

3Commencement

These Rules come into operation on 1 March 2017.

4Principal Rules

In these Rules, the Victorian Civil and Administrative Tribunal Rules 2008[1] are called the Principal Rules.

5Principal registrar may exercise certain Tribunal functions

(1)In Rule 9.01 of the Principal Rules omit "(other than the Planning and Environment List)".

(2)In Rule 9.01(q) of the Principal Rules, for "Act." substitute "Act;".

(3)After Rule 9.01(q) of the Principal Rules insert—

"(r)making of procedural directions or listing directions if—

(i)the principal registrar is acting in accordance with standing instructions given by the Head of List; or

(ii)the principal registrar is acting in accordance with instructions given by the Head of List or a Deputy Head of List in relation to the proceeding.".
