Victorian Civil and Administrative Tribunal Act 1998

Victorian Civil and Administrative Tribunal (Amendment No. 17) Rules 2017

The Rules Committee established by section 150 of the Victorian Civil and Administrative Tribunal Act 1998 makes the following Rules:

1Object

The object of these Rules is to amend the Victorian Civil and Administrative Tribunal Rules 2008—

(a)to omit a requirement for applications to the Tribunal to be accompanied by a statutory declaration if the applicant is a person or entity established for charitable purposes; and

(b)to make minor amendments to the functions of the review and regulation list and the building and property list of the Tribunal.

2Authorising provisions

These Rules are made under section 157 of the Victorian Civil and Administrative Tribunal Act 1998 and all other enabling powers.

3Commencement

These Rules come into operation on 1 June 2017.

4Principal Rules

In these Rules, the Victorian Civil and Administrative Tribunal Rules 2008[1] are called the Principal Rules.

5Information in relation to fee payer status to accompany applications

(1)In Rule 4.05B of the Principal Rules, for "For" substitute "Subject to subrule (2), for".

(2)At the end of Rule 4.05B of the Principal Rules insert

"(2)An application referred to in subrule (1) is not required to be accompanied by a statutory declaration if the applicant is a person or entity that has as its whole or dominant purpose a charitable, benevolent, or philanthropic purpose, other than a school or a government body.".

6Clause 5 of Schedule 1

(1)In Clause 5 of Schedule 1 to the Principal Rules, in item 5.9—

(a)for "182A" substitute "186";

(b)after "Schedule 7" insert "and clause 4(3) and (4) of Schedule 8".

(2)In Clause 5 of Schedule 1 to the Principal Rules, after item 5.12 insert

"5.12AChild Wellbeing and Safety Act 2005;".

(3)In Clause 5 of Schedule 1 to the Principal Rules, after item 5.35 insert

"5.35AHealthComplaints Act 2016;".

(4)In Clause 5 of Schedule 1 to the Principal Rules, after item 5.60 insert

"5.60AARooming House Operators Act 2016;".

7Clause 7 of Schedule 1

In Clause 7 of Schedule 1 to the Principal Rules, in item 7.2—

(a)for "182A" substitute "186";

(b)after "Schedule 7" insert "and clause 4(3) and (4) of Schedule 8".
