Heavy Vehicle National Law Application Act 2013

Heavy Vehicle National Law Application (Infringements) Amendment Regulations 2017

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Heavy Vehicle National Law Application (Infringements) Regulations 2013—

(a)to prescribe certain offences to be infringement offences under the Heavy Vehicle National Law (Victoria); and

(b)to revoke provisions that prescribe certain offences to be infringement offences under the Heavy Vehicle National Law (Victoria).

2Authorising provision

These Regulations are made under section 54 of the Heavy Vehicle National Law Application Act 2013.

3Commencement

These Regulations come into operation on


21 July 2017.

4Principal Regulations

In these Regulations, the Heavy Vehicle National Law Application (Infringements) Regulations 2013[1] are called the Principal Regulations.

5Definition

(1)For the heading to regulation 4 of the Principal Regulations substitute

"Definitions".

(2)In regulation 4 of the Principal Regulations insert the following definition—

"the FM Regulation means the Heavy Vehicle (Fatigue Management) National Regulation;

Note

The FM Regulation is a national regulation made by the Queensland Governor in accordance with section 730 of the Heavy Vehicle National Law (Victoria) and published on the NSW legislation website in accordance with section 733 of the Heavy Vehicle National Law (Victoria).".

6Schedule amended—Infringements—prescribed offences

(1)After item 174 of Part 1 of the Schedule to the Principal Regulations insert

"174AAn offence against section 466(2A) of the National Law.

174BAn offence against section 466(2B) of the National Law.".

(2)After item 194A of Part 1 of the Schedule to the Principal Regulations insert

"194BAn offence against section 531A(4) of the National Law.

194CAn offence against section 531A(5) of the National Law.".

(3)Item 202 of Part 2 of the Schedule to the Principal Regulations is revoked.

(4)Item 206 of Part 2 of the Schedule to the Principal Regulations is revoked.

(5)After Part 2 of the Schedule to the Principal Regulations insert

"Part 3—Offences under the Heavy Vehicle (Fatigue Management) National Regulation
