Building Further Amendment Regulations 2017

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Building Interim Regulations 2017—

(a)to make a consequential amendment arising from the commencement of the Building Amendment (Enforcement and Other Measures) Act 2017; and

(b)to make changes to the prescribed qualifications for the registration of certain classes of building practitioner; and

(c)to make other miscellaneous amendments.

2Authorising provisions

These Regulations are made under sections 7, 261 and 262 of, and Schedule 1 to, the Building Act 1993.

3Commencement

(1)These Regulations (except regulation 6) come into operation on the day on which they are made.

(2)Regulation 6 comes into operation on 16 August 2017.

4Principal Regulations

In these Regulations, the Building Interim Regulations 2017[1] are called the Principal Regulations.

5Septic tank systems

For regulation 801(2) of the Principal Regulations substitute

"(2)The report and consent of the relevant council need not be obtained to an application for a building permit referred to in subregulation (1) if a permit for the construction, installation or alteration of the septic tank system that is relevant to the application has been issued under section 53M(5) of the Environment Protection Act 1970.".

6Emergency orders

In regulation 903 of the Principal Regulations, for "section 103" substitute "sections 103, 104 and 105A".

7Statute law revision amendment—Commercial builder (limited)—construction of low rise building work

In regulation 2003 of the Principal Regulations, for "low risk" substitute "low rise".

8Amendment of Schedule 7—Prescribed classes of building practitioners and prescribed qualifications

(1)Clauses 13(a)(iv) and (viii) and 14(a)(i) of Schedule 7 to the Principal Regulations are revoked.

(2)In clauses 13(a)(vii) and 14(a)(v) of Schedule 7 to the Principal Regulations, for "Institute" substitute "University of Technology".

(3)After clause 14(a)(iv) of Schedule 7 to the Principal Regulations insert

"(iva)a Bachelor of Engineering (Mechanical Engineering) (Honours) from RMIT University; or".

(4)Before clause 15(a)(i) of Schedule 7 to the Principal Regulations insert

"(iaa)a Bachelor of Electrical and Electronic Engineering (Honours) from Deakin University; or".

(5)After clause 15(a)(i) of Schedule 7 to the Principal Regulations insert

"(ia)a Bachelor of Engineering (Electrical and Electronic) (Honours) from Swinburne University of Technology; or".

(6)For clause 16(a)(i) of Schedule 7 to the Principal Regulations substitute

"(i)a Graduate Certificate in Performance Based Building and Fire Codes from Victoria University, and any prescribed qualification for registration in the class of engineer (civil) or the class of engineer (mechanical) or the class of engineer (electrical); or".

(7)In clause 64(a)(iii) of Schedule 7 to the Principal Regulations, for "Institute" substitute "University".
