Magistrates' Court Act 1989

Magistrates' Court Criminal Procedure (Amendment No. 7) Rules 2017

The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:

1Object

The object of these Rules is to amend the Magistrates' Court Criminal Procedure Rules 2009 to substitute references to the term "child pornography" in Forms 8 and 9 of those Rules with references to the term "child abuse material" as a consequence of amendments made by the Crimes Amendment (Sexual Offences) Act 2016 to the Crimes Act 1958.

2Authorising provisions

These Rules are made under section 16 of the Magistrates' Court Act 1989 and all other enabling powers.

3Commencement

These Rules come into operation on 7 August 2017.

4Amendment of Form 8

In Form 8 of the Magistrates' Court Criminal Procedure Rules 2009[1], for "child pornography" substitute "child abuse material".

5Amendment of Form 9

In Form 9 of the Magistrates' Court Criminal Procedure Rules 2009, for "child pornography" substitute "child abuse material".
