Improving Cancer Outcomes (Screening Reporting) Amendment Regulations 2017

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Improving Cancer Outcomes (Screening Reporting) Regulations 2015—

(a)to remove the requirement for entities to report prescribed information in relation to cervical cancer screening to the Secretary; and

(b)to make consequential amendments.

2Authorising provision

These Regulations are made under section 28 of the Improving Cancer Outcomes Act 2014.

3Commencement

These Regulations come into operation on 1 December 2017.

4Principal Regulations

In these Regulations, the Improving Cancer Outcomes (Screening Reporting) Regulations 2015[1] are called the Principal Regulations.

5Regulations 4, 5 and 6 substituted

For regulations 4, 5 and 6 of the Principal Regulations substitute

"4   Types of cancer screening to be reported

For the purposes of section 8(1) of the Improving Cancer Outcomes Act 2014, mammography, mammographic screening and subsequent radiology, pathology or clinical testing or procedures undergone in order to determine whether an individual has cancer, or a precursor to cancer, of the breast, is cancer screening of a prescribed type.

5Entities required to report cancer screening

For the purposes of section 8(1) of the Improving Cancer Outcomes Act 2014, any organisation that conducts cancer screening of a kind specified in regulation 4 on behalf of Breast Screen Victoria Inc. is a prescribed organisation.

6Cancer screening reports

For the purposes of section 8(2) of the Improving Cancer Outcomes Act 2014

(a)a report of cancer screening is in the prescribed form if it contains the prescribed information; and

(b)the prescribed information to be included in a report for cancer screening of a type referred to in regulation 4 is the information set out in Schedule 1.".

6Schedule 1—Prescribed information about breast screening

In Schedule 1 to the Principal Regulations, for "(c)(i)" substitute "(b)".

7Schedule 2 revoked

Schedule 2 to the Principal Regulations is revoked.

8Schedule 3 revoked

Schedule 3 to the Principal Regulations is revoked.
