Supreme Court (E-Filing Further Amendment) Rules 2017

The Judges of the Supreme Court make the following Rules:

Part 1—Preliminary

1Object

The object of these Rules is to amend Chapters I and VII of the Rules of the Supreme Court in relation to electronic filing in certain Lists of the Supreme Court.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 2 January 2018.

Part 2—Amendment of Chapter I

4Application of Order 28A

(1)After Rule 28A.01(1)(b) of the Supreme Court (General Civil Procedure) Rules 2015[1], insert—

"(ba)the List known as the Taxation List (which, for the avoidance of doubt, is a List which may include, but is not limited to, proceedings to which Order 7 of Chapter II applies);

(bb)the List known as the Arbitration List (which, for the avoidance of doubt, is a List which may include, but is not limited to, proceedings to which Order 9 of Chapter II applies);".

(2)In Rule 28A.01(1)(c) of the Supreme Court (General Civil Procedure) Rules 2015 omit "or".

(3)After Rule 28A.01(1)(c) of the Supreme Court (General Civil Procedure) Rules 2015 insert—

"(ca)the Admiralty List pursuant to Rule 3.02(1) of Chapter VII; or".

Part 3—Amendment of Chapter VII

5Definitions

In Rule 1.06 of the Supreme Court Admiralty Rules 2010[2] insert the following definition—

"RedCrest means the electronic filing and case management system in operation in the Court from time to time, other than the system for electronic filing to which Part 2 of Order 28 of Chapter I applies;".

6Entry into the List

At the foot of Rule 3.02(1), (2) and (3) of the Supreme Court Admiralty Rules 2010 insert the following note—

"Note

See Rule 28A.01(1) of Chapter I (electronic filing in RedCrest).".

7Removal from the List

At the foot of Rule 3.03 of the Supreme Court Admiralty Rules 2010 insert the following note—

"Note

See Rule 28A.01(1) of Chapter I (electronic filing in RedCrest).".
