Bail Amendment Regulations 2017

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Bail Regulations 2012 to make changes consequential to the commencement of relevant provisions of the Fines Reform Act 2014 and to make other minor and technical amendments.

2Authorising provision

These Regulations are made under section 33 of the Bail Act 1977.

3Commencement

These Regulations come into operation on 31 December 2017.

4Principal Regulations

In these Regulations, the Bail Regulations 2012[1] are called the Principal Regulations.

5Statement for a person in custody when bail is refused or objection is taken to the amount or conditions of bail

In regulation 10 of the Principal Regulations, for "under section 84(5) of the Infringements Act 2006" substitute "under section 115(5) of the Fines Reform Act 2014".

6Form 1

(1)In Form 1 of the Principal Regulations, for "an infringement warrant issued under section 80 of the Infringements Act 2006" substitute "an enforcement warrant issued under section 106 of the Fines Reform Act 2014".

(2)In Form 1 of the Principal Regulations, for "*the accused/infringement offender" (wherever occurring) substitute "the *accused/*infringement offender/


*fine defaulter".

(3)In Form 1 of the Principal Regulations, before "(c)" insert "*".

(4)In Form 1 of the Principal Regulations, for "*Accused/Infringement Offender" (where twice occurring) substitute "*Accused/*Infringement Offender/


*Fine Defaulter".

(5)In Form 1 of the Principal Regulations, before "I enter this undertaking of bail and acknowledge receipt of a notice setting out the obligations of the *accused/infringement offender" (where twice occurring) insert "*".

(6)In Form 1 of the Principal Regulations, for "*accused/infringement offender" (wherever occurring) substitute "*accused/*infringement offender/*fine defaulter".

(7)In Form 1 of the Principal Regulations, for "Accused/Infringement Offender" (where twice occurring) substitute "Accused/*Infringement Offender/*Fine Defaulter".

(8)In Form 1 of the Principal Regulations, for "Infringements Court Case Number that appears on the Infringement warrant" substitute "*Case number(s) on the enforcement warrant(s)".

7Form 2A

(1)In the heading to Form 2A of the Principal Regulations, for "OFFENDER" substitute "OFFENDER/*FINE DEFAULTER".

(2)In Form 2A of the Principal Regulations, for "[police informant and prosecuting agency]" substitute "[*police informant and prosecuting agency/*Director, Fines Victoria]".

(3)In Form 2A of the Principal Regulations, for "*Accused/*Infringement offender:" substitute "*Accused/*Infringement Offender/*Fine Defaulter:".

9Form 5

In Form 5 of the Principal Regulations, for "In the case of an infringement warrant within the meaning of the Infringements Act 2006, the sheriff or a person authorised under section 84(5) of that Act" substitute "In the case of an enforcement warrant within the meaning of the Fines Reform Act 2014, the sheriff or a person authorised under section 115(5) of that Act".

10Form 7

In Form 7 of the Principal Regulations, for "section 84(5) of the Infringements Act 2006" (wherever occurring) substitute "section 115(5) of the Fines Reform Act 2014".
