Marine Safety Act 2010

Marine Safety Further Amendment Regulations 2017

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Marine Safety Regulations 2012—

(a)to make a consequential amendment as a consequence of the commencement of the Fines Reform Act 2014; and

(b)to make an amendment to the services prescribed for the purposes of Division 3 of Part 8.1 of the Marine Safety Act 2010; and

(c)to make other minor amendments.

2Authorising provision

These Regulations are made under section 309 of the Marine Safety Act 2010.

3Commencement

These Regulations come into operation on 31 December 2017.

4Prescribed period for providing an effective statement

In regulation 117 of the Marine Safety Regulations 2012[1], for paragraph (a)


substitute

"(a)if the infringement notice was served on a person other than a child and the fine is an infringement fine within the meaning of the Fines Reform Act 2014 that may be registered under section 16 of that Act, the period beginning on the date of the notice and ending immediately before the infringement fine is registered under section 16 of that Act; or".

5Prescribed place for publication of an urgent safety rule

In regulation 128 of the Marine Safety Regulations 2012, for "Information Victoria, 505 Little Collins Street, Melbourne" substitute "Transport Safety Victoria, 121 Exhibition Street, Melbourne".

6Prescribed services

In regulation 131 of the Marine Safety Regulations 2012—

(a)in paragraph (b), after "testing" insert "(except medical testing)";

(b)in paragraph (c), after "assessment" insert "(except medical assessment)".

7Prescribed place for the availability of an approved code of practice

In regulation 135 of the Marine Safety Regulations 2012, for "Information Victoria, 505 Little Collins Street, Melbourne" substitute "Transport Safety Victoria, 121 Exhibition Street, Melbourne".
