County Court Act 1958

County Court (Chapter I Circuit Fees, Expenses and Allowances Amendment) Rules 2017

A majority of the Judges of the County Court makes the following Rules:

1Object

The object of these Rules is to amend Chapter I of the Rules of the County Court to provide for an increase to—

(a)the circuit fees in Schedule 1 to those Rules; and

(b)the witnesses' expenses and interpreters' allowances in Schedule 2 to those Rules.

2Authorising provisions

These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers.

3Commencement

These Rules come into operation on 1 January 2018.

4Schedule 1 substituted

For Schedule 1 to the County Court Civil Procedure Rules 2008[1] substitute—

5Witnesses' expenses and interpreters' allowances

(1)In clause 1(1) of Schedule 2 to the County Court Civil Procedure Rules 2008—

(a)for "$186.00–$373.00" substitute

"$190.00–$381.00";

(b)for "$2315.00" substitute "$2365.00".

(2)In clause 1(2) of Schedule 2 to the County Court Civil Procedure Rules 2008, for "$386.00" substitute "$394.00".

(3)In clause 1(2) and (3) of Schedule 2 to the County Court Civil Procedure Rules 2008, for "$694.00" substitute "$709.00".

(4)In clause 1(3) of Schedule 2 to the County Court Civil Procedure Rules 2008, for "$115.00" substitute "$117.00".

(5)In clause 3(1) of Schedule 2 to the County Court Civil Procedure Rules 2008, for "$78.00" substitute "$79.00".

(6)In clause 3(1) and (2) of Schedule 2 to the County Court Civil Procedure Rules 2008—

(a)for "$55.00" substitute "$56.00";

(b)for "$336.00" substitute "$343.00".

(7)In clause 3(2) of Schedule 2 to the County Court Civil Procedure Rules 2008, for "$193.00" substitute "$197.00".
