Police Regulation (Selection and

Review) Act 1996†

[Assented to 2 July 1996]

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to amend the Police Regulation Act 1958 in relation to methods of promotion and transfer in the police force.

2. Commencement

(1) Section 1 and this section come into operation on

the day on which this Act receives the Royal
Assent.

(2) Subject to sub-section (3), the remaining

provisions of this Act come into operation on a

day to be proclaimed.

(3) If the provisions referred to in sub-section (2) do

not come into operation within the period of 6
months beginning on, and including, the day on
which this Act receives the Royal Assent, it
comes into operation on the first day after the end
of that period.

3.  Appeals against non-selection for promotion not available to constables or senior constables

After section 8AA(2) of the Police Regulation

Act 1958 insert—

"(2A) No appeal may be had in relation to a

position of constable (general duties) or
senior constable (general duties).".

4.  Grounds for promotion not to apply to constables or senior constables

(1) After section 8AB(1) of the Police Regulation

Act 1958 insert—

"(1A) This section does not apply to a promotion or

transfer to a position of constable (general
duties) or senior constable (general duties).".

(2) In section 8AB(2) of the Police Regulation Act 1958 after the definition of "efficiency" insert— '"general duties" means primary response and

general patrol duties;'.

5. Application for review

(1) In section 91F of the Police Regulation Act 1958

for "A member of the force" substitute—

"(1) Subject to this section, a member of the

force".

(2) After section 91F(e) of the Police Regulation Act

1958 insert—

"or

(f)

that the member is unsuitable for promotion to a position of senior constable (general duties).".

(3) At the end of section 91F of the Police

Regulation Act 1958 insert—

"(2) Sub-section (1)(d) does not apply to the

compulsory transfer of—

(a) a superintendent, chief superintendent
or commander; or

(b)

an inspector or chief inspector except where the transfer is to or from a country police district for a period of more than 6 months.

(3) The Chief Commissioner may from time to

time determine any area to be the Melbourne
metropolitan area for the purposes of this

section.

(4) In this section—

"country police district" means any police

district outside the Melbourne
metropolitan area determined under this

section;

"general duties" means primary response

and general patrol duties.".
