Education (Work Experience) Act 1997†

[Assented to 5 November 1997]

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to amend the work experience arrangements.

2. Commencement

(1) Section 1 and this section come into operation on

the day on which this Act receives the Royal

Assent.

(2) The remaining provisions of this Act come into

operation on 1 February 1998.

3. Definitions

In section 64L of the Education Act 1958, the

definition of "prescribed" is repealed.

4. Work experience arrangements

After section 64LB(2) of the Education Act 1958
insert—
"(3) A work experience arrangement under sub-

section (1) must not be made in respect of a pupil of or over the age of 21 years without the written approval of the Minister being

obtained.

(4) An approval under sub-section (3) may be

given subject to such terms and conditions as
the Minister may specify.".

5.  Certain laws etc. not to apply where employment is to gain work experience

(1) In section 64M(5) of the Education Act 1958

after "factory" insert "or in a class of employment declared by an Order made by the Minister to be a class of employment where, in the opinion of the

Minister, there is a higher than usual possibility of a pupil being exposed to the risk of physical injury.".

(2) In section 64M(5)(b) of the Education Act

1958—

(a)

for "an inspector of Factories and Shops in the Department of Labour and Industry"

substitute "the Secretary to the Department

of State Development";

(b)

for "an inspector may" substitute "the Secretary may".

6. Conditions of employment

(1) In section 64N(1) of the Education Act 1958—

(a) in paragraph (a)—

(i) for "36" substitute "40"; and (ii) for "twelve" substitute "10";

(b)

for paragraph (b) substitute— "(b) the principal or head teacher of a school

may make a work experience
arrangement with an employer for the
placement of a particular pupil with
that employer for specified periods

during a school year;";

(c) in paragraph (d) for "twelve" substitute "10".

(2) In section 64N(3) of the Education Act 1958 for "as prescribed" substitute "by an Order made by the Minister under section 64S".

7. Payment

In section 64Q(1)(a) of the Education Act 1958 for "as fixed by Order of the Governor in Council" substitute "fixed under section 64S".

8. Repeal of section 64R

Section 64R of the Education Act 1958 is repealed.

9. Substitution of section 64S

For section 64S of the Education Act 1958 substitute—

"64S. Orders about work experience

arrangements

(1) The Minister may make Orders about the

placement of pupils with employers for obtaining work experience as part of a pupil's education.

(2) Without limiting the generality of sub-

section (1) an Order may provide for—

(a) the number of pupils which an employer or class of employer is permitted to employ under a work experience arrangement;
(b) the minimum rate of payment payable to a pupil employed under a work experience arrangement;
(c) the hours of the day in which a pupil can work under a work experience arrangement;
(d)

experience arrangements including

any other terms and conditions for work to in section 64LB(2).".

10. Ministerial orders

In section 84(1) of the Education Act 1958 for "or 64LD" substitute ", 64LD, 64M(5) or 64S".
