V.' . the University Site, and for other consequential N;H~' P urposes • UNIVERSITY SITE ACT OF 1922. [ASSENTED TO 14TH OCTOBER, 1922.] ·WHEREAS by a Deed of Grant under the hand of His Preamble. Excellency Major Sir Hamilton John Goold-Adams, ~ Knight Grand Cross of the Most Distinguished Order of St. Michael and St. George, Companion of the Most Honourable Order of the Bath, and the Seal of the State 'of Queensland, dated the sixth day of August, one thousand nine hundred and seventeen, and numbered 106220 (hereinafter referred to as the" Trust Deed of the University Reserve"), certain lands (hereinafter referred to as the University Reserve) situated in the county of· Stanley, parish of North Brisbane and State of Queensland, and conta.ining by admeasurement sixty acres two roods and twenty-six perches more or less, and being the la·nds described in the first part of the First Sched. I•• Schedule hereto, the boundaries whereof are delineated Part I. and marked red on the plan in the Second Schedule Sched. H. hereto, were gr.anted by His Majesty King George the Fifth unto the ~ ecretary for Public Instruction in Queensland, his successors and assigns, subject to the trusts, conditions, reservations, and provisoes in the said Deed of Grant contained, upon trust .as a site for a University and for no other purpose whatsoever: And whereas by another Deed of Grant under the hand of His Excellency Frederic John Napier, Baron 'Chelmsford, Knight Commander of the Most Distinguished Order of St. Michael and St. George, and the Seal of the said State, dated the twenty-eighth day of November, one thousand nine hundred and eight, and numbered 95698 (hereinafter referred to as the" Trust Deed of Victoria Park"):, certain other lands (hereinafter referred to as Victoria Park), situated in the said county and parish, and adjoining the University Reserve, and containing by. admeasurement two hundred and ten acres two roods and eJeven perches more or less, exclusive of a certain .area therein comprised reserved for road and railway purposes, and being the lands described in the second

II. part of the First Schedule hereto, were granted by His late Majesty King Edward the Seventh unto the Council of the City of Brisbane as Trustees and their successors~ subject to the trusts, conditions, reservations, and provisoes in the said Deed of Grant contained upon trust as a Reserve for a PubJic Park and for no other purpose whatsoever: And whereas a further area of land therein comprised~ and shown upon the plan in the Second Schedule hereto~ is required to be reserved for railway purposes: And whereas the University Reserve is insufficient in area for the purpose of providing a suitable permanent site for the University of Queensland: And whereas for the purpose of providing such a. site it has been agreed, so far as it lawfully may, between the Secretary for Public Instruction in Queensland as Trustee of the University Reserve, the Council of the City of Brisbane as Trustees of Victoria Park, and the Senate of the University of Queensland, that the said Council shall surrender to His Majesty a certain portion of Victoria Park, to the end that the same may be granted by His Majesty, subject to certain conditions, reservations~ and provisions hereinafter set out, to the University of Queensland to be used in conjunction with the University Reserve for the purposes of the University and for no other purpose whatsoever: And whereas it is desirable that the said Agreement should be carried into effect, and that the sgid further area of land should be reserved for railway purposes~ and that for such purposes the said Council should be authorised to surrender Victoria Park to His Majesty free from the trusts at present affecting the same, and that a new grant of Victorig pgrk as redefined should be made to the said Council upon the same trusts as heretoiore : Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title. 1. This Act may be cited as "The University Site Act of 1922."

In this Act, unless the context otherwise indicates, Interpreta. the following terms have the meanings respectively set tion. out against them, that is to say- "Council "-The Council of the City of Brisbane, its successors and assigns. " Secretary for Public Instruction"-The Secretary for Public Instruction in Queensland, its successors and assigns, as Trustee of the University Reserve. " University"-The University of Queensland. " University Grounds"-The lands described in the third part of the First Schedule to this Act, Seh. I., the boundaries whereof are delineated and Part Ill. marked blue upon the plan in the Second Seh. Il. Schedule to this Act, together with the University Reserve. 3. (1.) Notwithstanding anything in the Trust Deed Surr~ nders of V 1 · 0 t on.a P arkor'In any I a - wor stat ute t 0 the cont rary, annewd ITssruueso t f · the Council shall surrender to His Majesty Victoria Park Deeds. free from all trusts at present affecting the same, and upon such surrender the Trust Deed of Victoria Park shall be cancelled and rescinded. The Secretary for Public Instruction shall also surrender to His Majesty the University Reserve, and thereupon the Trust Deed of the University Reserve shall be cancelled and rescinded. (2.) Thereupon a new Deed of Grant shall be issued vesting in the University, subject to this Act, the University Grounds, being the lands the boundaries whereof are delineated and marked red and blue on the plan in the Second Schedule to this Act, and containing Seh. JI. by admeasurement one hundred and sixty-eight acres three roods and six perches more or less, for the purposes of the University and for no other purpose whatsoever, and a new Deed of Grant for Victoria Park as redefined, being the lands described in the fourth part of the First Schedule Seh. I., to this Act, and containing by admeasurement ninety-six Part IV.. acres and ten perches more or less, the boundaries whereof are delineated and marked green on the plan in the Second Schedule to this Act, shall be issued to and in the Seh. n .. name of the Council, upon and subject in every respect to the same trusts, conditions, reservations, and provisions as those upon which the Council now holds Victoria Park.

The public shall at all times have free and unrestricted access to the whole of the University Grounds, with the exception of such portions thereof as may be occupied by the University buildings and the land appurtenant thereto. I.. part of the First Schedule to this Act are not required or Part Ill. have ceased to be used for the purposes of the University, then and immediately thereupon the said lands shall revert to and be again vested by a Deed of Grant in thfl Council, upon the trusts and subject to the conditions, reservations, and provisions of the Trust Deed of Victoria Park. . 'Roads, &c. Drainage, ·&c. 6. (1.) The cost of the formation and maintenance of all roads which may be required by the University in, over, or through the University Grounds shall be borne by the University. (2.) Such drains or sewerage connections as may be required to provide for storm waters falling on the lands of the University, and sewage from University buildings, shall be constructed and maintained by the University to the approval and satisfaction of the Council's engineer. Gates. :Surveys. (3.) All gates which may be required for the purpose of affording the public convenient and easy access to the University Grounds from the adjacent roads and the railway lands shall be erected and maintained by the University. (4.) The cost of all surveys which have been mad8 by the Council, or which may hereafter be necessary for carrying this Act into effect, and all other costs of and incidental to the preparation, execution, and registration of any instruments necessary for carrying this Act into effect, shall be borne by the University. All that piece or parcel of land, situate in the county of Stanley, \parish of North Brisbane and city of Brisbane, being portion 341, and containing by admeasurement sixty acres two roods and twenty- six perches, be the same more or less, being the whole of the land .contained in Deed of Grant No. 106220, volume 1366, folio 230. 9987 PART Il. Victoria Park. All that piece or parcel of land, situate in the county of Stanley, parish of North Brisbane and city of Brisbane, being portion 324, and containing by admeasurement two hundred and ten acres two roods and eleven perches, be the same more or less, being the whole ,of the land contained in Deed of Grant No. 95698, volume 1106, lolio 208. PART Ill. Addition to University Site. All that piece or parcel of land, situate in the county of Stanley) parish of North Brisbane and city of Brisbane, containing by admeasure- ment one hundred and eight acres and twenty perches, be the same more or less, being portion 324A, and commencing at the south-west corner of portion 341, and bounded thence by that portion bearing Qne hundred and twenty-four degrees forty-one minutes forty-five seconds twelve chains eighteen links and four-tenths of a link, three hundred and fifty-nine degrees thirty-nine minutes fifteen seconds seven chains two links and three-tenths of a link, three hundred and forty-one degrees twenty-two minutes fifteen seconds six chains thirty- two links and four-tenths of a link, three hundred and fifty-nine ·degrees forty-eight minutes fifteen seconds four chains, forty-four degrees forty-eight minutes fifteen seconds four chains ninety-four links and nine-tenths of a link, thirty degrees twenty-three minutes fifteen seconds five chains eleven links and one-tenth of a link, and three hundred and thirty-five degrees thirty-two minutes fifteen seconds nine chains ninety-five links: by Herston road bearing eighty- ,eight degrees fifteen chains thirteen links and seven-tenths of a link; by portion 324 bearing one hundred and fifty-nine degrees fifty-eight minutes thirty-five chains eighty-four links and a half link; by lines parallel to and distant one chain seventy-five links from the centre line of the Exhibition Branch Railway south-westerly to the east corner of portion 282; by that portion bearing three hundred and thirty degrees seventeen minutes forty seconds ten chains sixty-five links and seven-tenths of a link, and two hundred and twenty degrees four minutes forty seconds four chains eighty-eight links and seven- tenths of a link; and thence by Victoria Park road bearing three hundred and twenty-seven degrees five minutes forty seconds six •
