(Relating to the election of student members of the Council of the University and
to the term of office of the Warden of Convocation)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the University of Technology, Sydney, Act 1989, has been pleased to approve the By-law made by the Council of the University of Technology, Sydney, and set forth hereunder.

Commencement
1. This By-law commences on Thursday 13 April 1995.
Amendments
2. The University of Technology, Sydney, By-law 1990 is amended:
| (a) | by inserting in the definition of “student” in clause 7 (1) after the word “University” the words “, and includes both an undergraduate student and a postgraduate student” ; |
| (b) | by omitting clause 14 (1) (c) and by inserting instead the following paragraphs: |
(c)
for the purposes of section 9 (5) (c) of the Act, a Roll of Undergraduate Students containing the names and addresses of those persons enrolled in courses that are listed in the register of undergraduate courses of the University with a minimum duration of one year full-time or equivalent; and

(cl) for the purposes of section 9 (5) (cl) of the Act, a Roll of Postgraduate Students containing the names and addresses of those persons enrolled in courses that are listed in the register of postgraduate courses of the University with a minimum duration of one year full-time or equivalent; and
(c) by omitting clause 17 and by inserting instead the following clauses: Election of undergraduate student
17. For the purposes of section 9 (5) (c) of the Act:
(a)
in respect of a person seeking election as an undergraduate student of the University, the prescribed qualifications are that the person’s name is entered in the Roll of Undergraduate Students at the time specified for the close of nominations for the election and is not entered on the Roll of Academic Staff or the Roll of Non-Academic Staff; and
(b)
the undergraduate student is to be elected by the persons whose names are entered in the Roll of Undergraduate Students at the time specified for the close of nominations for the election.
Election of postgraduate student
17A. For the purposes of section 9 (5) (cl) of the Act:
(a) in respect of a person seeking election as a postgraduate student of the University, the prescribed qualifications are that: (i) the person’s name is entered in the Roll of Postgraduate Students at the time specified for the close of nominations for the election and is not entered on the Roll of Academic Staff or the Roll of Non-Academic Staff; and
(ii) the person’s name has not been so entered in the Roll of Postgraduate Students for a period exceeding 2 years after 1 November 1994; and
(b)
the postgraduate student is to be elected by the persons whose names are entered in the Roll of Postgraduate Students at the time specified for the close of nominations for the election.
(d)
by omitting from clause 18 (a) the words “or the Roll of Students” and by inserting instead the words “, the Roll of Undergraduate Students or the Roll of Postgraduate Students”;

(e)
by omitting from clause 18A (1) (b) the word “students” and by inserting instead the words “the persons whose names are on the relevant roll of students of the University”;
(f)
by omitting from clause 18E (2) (c) the words “student who has applied for the issue of a ballot paper by post and whose” and by inserting instead the words “person whose name is on the relevant roll of students of the University if the person has applied for the issue of a ballot paper by post and the”;
(g)
by omitting from clause 18J (2) and (4) the words “ballot box” wherever occurring and by inserting instead the words “relevant ballot box”;
(h)
by omitting from clause 39 (a) the matter “4 years” and by inserting instead the matter “2 years”.
Transitional
3. Nothing in this By-law affects the term of office of the person holding office as Warden of Convocation immediately before the commencement of this By-law. Clause 39 (a) of the University of Technology, Sydney, By-law 1990, as in force immediately before the amendment to that clause made by clause 2 (h) of this By-law, continues to apply in respect of the term of office of that person.

EXPLANATORY NOTE
This By-law is, for the most part, consequential on amendments to the University of Technology, Sydney, Act 1989 made by the Statute Law (Miscellaneous Provisions) Act (No. 2) 1994. Those amendments (among other things) increased the student membership of the Council of the University from one to two-one undergraduate student member and one postgraduate student member.
This By-law makes the amendments to the University of Technology, Sydney, By- law 1990 that are required by that change in the composition of the Council (clause (2) (a)-(g)). It also reduces the term of office of the Warden of Convocation from 4 years to 2 (clause (2) (h)).
