BY-LAW

(Relating to ceremonial occasions and student discipline)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the University of Technology, Sydney, Act 1989, has been pleased to approve the By-law made by the Council of the University of Technology, Sydney, and set forth hereunder.

The University of Technology, Sydney, By-law 1990 is amended:

(a) by omitting clause 8 (3) and by inserting instead the following subclauses :

(3) In the absence of both the Chancellor and Deputy Chancellor, a member of the Council (being a member who is not a member of the staff of the University or a student), appointed by the Council, is to preside at ceremonial occasions.

(4) In the absence of the Chancellor, Deputy Chancellor and the member appointed in accordance with subclause (3), the Vice-Chancellor is to preside at ceremonial occasions.

(b)

by omitting clause 87 (c) and by inserting instead the following paragraph:

(c)

if the breach constitutes academic misconduct—be awarded a zero mark for the results of any or all forms of assessment for a course of study, unit or subject in which the student is admitted or enrolled; or

(c) by inserting at the end of clause 87 the following subclause:

(2) The Council may make rules for the purposes of subclause (1) (c) generally with respect to the awarding of a zero mark and in particular with respect to the following matters:

(a)

specifying the types of breaches of discipline that constitute academic misconduct;

(b) the manner of recording any zero mark awarded;

(c)

the period in relation to which a zero mark may be awarded.

EXPLANATORY NOTE

The object of this By-law is to enable the Council to appoint an external member of the Council to preside at ceremonial functions if the Chancellor and Deputy Chancellor are absent. In the absence of that appointed member, the Vice-Chancellor is to preside.

The By-law also clarifies a provision relating to student discipline. At present, the University of Technology, Sydney, By-law 1990 provides that one of the penalties that may be imposed on a student by the Vice-Chancellor for a breach of discipline is that the student be denied accreditation for the results of any tests or other forms of assessment for any specified period of assessment not exceeding 12 months. This By-law replaces that provision and enables the Vice-Chancellor to direct, in a case of academic misconduct, that a zero mark be given for part or all of a student’s assessment for a course of study, unit or subject.

This By-law authorises rules to be made by the Council of the University with respect to the awarding of a zero mark and in particular to specify what constitutes academic misconduct, the manner of recording zero marks awarded to a student for academic misconduct and the period in relation to which a zero mark may be awarded.
