UNIVERSITY OF SYDNEY ACT 1989—BY-LAW

(Relating to the election of Fellows of the Senate of the University of

Sydney)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the University of Sydney Act 1989, has been pleased to approve the By-law of the University of Sydney made by the Senate and set forth hereunder.

The Senate of the University of Sydney, in pursuance of the University of Sydney Act 1989, makes the following By-law:

Amendment of Chapter 2

1. Chapter 2 of the By-laws of the University of Sydney is amended:

(a) by omitting section 8 and by inserting instead the following

section:

Election of Fellows

8. (1) For the purposes of section 9 (5) of the Act:

(a) the time when and the manner in which elections are to be

held; and

(b) the manner in which a vacancy in the office of an elected member is to be filled; and
(c) the members of staff of the University who are designated as academic staff, non-academic staff, full-time staff,

part-time staff or otherwise; and

(d) the students of the University who are designated as
undergraduate students, postgraduate students or

otherwise,

are to be as determined by resolution of the Senate.

(2) The Registrar is to be the returning officer for elections held

for the purposes of section 9 (5) of the Act.

(b) by omitting section 9 and by inserting instead the following section:

Election of 4 Fellows by and from academic staff

9. For the purposes of section 9 (5) of the Act, a person is a

member of the academic staff if, and only if, the person:

(a)

is the Vice-Chancellor, a Deputy Vice-Chancellor, the Registrar, the Bursar or the University Librarian; or

(b)

belongs to a class of members of staff that is designated by resolution of the Senate as comprising full-time or part-time members of academic staff; or

(c)

belongs to a class of members of staff that is designated by the Vice-Chancellor as comprising full-time or part-time members of the academic staff; or

(d) is a member of staff of:

(i) the New South Wales Department of Health; or

(ii) the National Occupational Health and Safety

Commission; or

(iii) the Menzies School of Health Research, Darwin,
on whom the Senate has conferred the title of Professor,

Reader, Associate Professor, Senior Lecturer or Lecturer.

(c) by omitting from section 10 the matter “section 7 (1) (d)” and by inserting instead the matter “section 9 (5) (a)”;
(d)

by omitting section 11 and by inserting instead the following Election of 1 Fellow by and from non-academic staff

11. For the purposes of section 9 (5) of the Act, a person is a member of the non-academic staff if, and only if, the person belongs to a class of members of staff that is designated by resolution of the Senate as comprising full-time or part-time members of non-academic staff.

(e)

by omitting from section 12 the matter “section 7 (1) (d1)” and by inserting instead the matter “section 9 (5) (b)”;

(f) by omitting from section 13 the matter “section 7 (1) (e)” and by inserting instead the matter “section 9 (5) (e)”;
(g) by omitting from section 14 the matter “section 7 (1) (f)” and by inserting instead the matter “section 9 ( 5 ) (c ) or (d)”;
(h) by inserting after section 14 the following sections:

Election of 1 Fellow by and from undergraduate students

15. For purposes of section 9 (5) of the Act, a person is an undergraduate if, and only if, the person belongs to a class of students that is designated by resolution of the Senate as comprising undergraduate students.

Election of 1 Fellow by and from postgraduate students

16. For purposes of section 9 (5) of the Act, a person is a
postgraduate student if, and only if, the person belongs to a class
of students that is designated by resolution of the Senate as
comprising postgraduate students.

Repeal of transitional by-law

2. The University of Sydney (Election of Fellows of the Senate) Transitional By-law 1989 is repealed.

EXPLANATORY NOTE

The object of this By-law is to repeal the University of Sydney (Election of Fellows of the Senate) Transitional By-law 1989 and to amend Chapter 2 (The Senate) of the By-laws of the University of Sydney so as:

(a) to provide that:

• the timing of, and the procedures for, the election of Fellows of the

Senate; and

• the filling of vacancies in the office of an elected member of the

Senate; and

• the designation of members of staff or other persons as academic or non-academic, full-time or part-time members of staff or otherwise for the purposes of the election of Fellows; and
• the designation of students as undergraduate or postgraduate

students or otherwise for purposes of the election of Fellows,

is to be determined by resolution of the Senate; and

(b) to extend the electorate and the eligbility for candidature for the election

of Fellows of the Senate by and from the academic staff to include all

non-casual employees of the University who are academic staff; and

(c)

to extend the electorate and the eligibility for candidature for the election of Fellows of the Senate elected by and from the non-academic staff to include all non-casual employees of the University who are members of the non-academic staff; and

(d)

to omit references in the Chapter to the University and University Colleges Act 1900 and insert appropriate references to the University of Sydney Act 1989 instead.

This By-law replaces the By-law that appeared in Gazette No. 139 of 4 October

1991 on pp. 8542–8544.
