AUSTRALIA AMENDMENT

ACT 1996

AN ACT to amend the University of Notre Dame Australia

Act 1989.

[Assented to 28 June 1996.]

The Parliament of Western Australia enacts as follows:

Short title

1. This Act may be cited as the University of Notre Dame

Australia Amendment Act 1996.

Amendment Act 1996

Principal Act

2.   In this Act the University of Notre Dame Australia Act 1989*

is referred to as the principal Act.

Section 25 amended

3.   Section 25 (1) of the principal Act is amended by inserting

after ‘‘body, and’’ the following —

‘‘

, other than as provided in section 25A,

’’.

Section 25A inserted

4.   After section 25 of the principal Act the following section is

inserted in Part 6 —

‘‘

Minister may lend to the University

25A. (1) The Minister may lend money to the University for capital works, provided they are for the purposes of the objects of the University.

Any such loan is to be made out of moneys

appropriated by Parliament for the purpose of

subsection (1).

(2)

(3) The terms and conditions of any such loan, including the interest to be paid, may be less onerous than those that might reasonably apply to such a loan made commercially.

(4) The terms and conditions of any such loan, including the interest to be paid, are to be approved by the Treasurer.

In subsection (1) —

‘‘capital works’’ means the acquisition of land, the construction, modification or renovation of buildings or the purchase of plant and equipment.
