His Excellency the Governor, with the advice of the Executive Council, has approved the following By-law made by the Council of the University of Newcastle under the University of Newcastle Act 1989.

Explanatory note

The University of Newcastle Act 1989 has recently been amended so as to increase the number of student members of the Council of the University from one to two, one being elected by the undergraduate students of the University and one by the postgraduate students (see Schedule 1.27 to the Statute Law (Miscellaneous Provisions) Act (No 2) 1999).

The objects of this By-law are:

(a)

to provide for the maintenance of separate rolls of undergraduate students and postgraduate students, instead of a single roll of students, and

(b)

to set out the qualifications of undergraduate representatives and postgraduate representatives and their term of office (being the same as for the present single student representative), and

(c)

to make other changes consequential on the recent amendments to the University of Newcastle Act 1989.

This By-law is made under the University of Newcastle Act 1989, including section
28 (the general power to make by-laws).

[1]     Clause 7 Qualifications of elected members

Omit “Roll of Students” from clause 7 (3).
Insert instead “Roll of Undergraduate Students”.

[2]     Clause 7 (3A)

Insert after clause 7 (3):

(3A) A person referred to in section 9 (5) (c1) of the Act has the prescribed qualifications in relation to an election if, at the close of nominations for that election, the person’s name is enrolled in the Roll of Postgraduate Students in relation to a course of studies that leads to a degree or diploma of the University.

[3]     Clause 8 Returning officer to keep rolls

Omit “Roll of Students” from clause 8 (c).
Insert instead “Roll of Undergraduate Students”.

Insert “undergraduate” after “being”.

[5]     Clause 8 (c1)

(c1) a Roll of Postgraduate Students, containing the names and addresses of all persons who are for the time being postgraduate students of the University, and
