His Excellency the Governor, with the advice of the Executive Council, has approved the following By-law made by the Council of the University of New South Wales under the University of New South Wales Act 1989.

Explanatory note
The object of this By-law is to amend the University of New South Wales By-law 2005 as a consequence of the Universities Legislation Amendment (Regulatory Reforms) Act 2014 which gives the Council of the University of New South Wales the power to make rules about certain election procedures.
This By-law is made under the University of New South Wales Act 1989, including section 27 (the general power to make by-laws).

1 Name of By-law
This By-law is the University of New South Wales Amendment By-law 2016.
2 Commencement
This By-law commences on the day on which it is published on the NSW legislation website.

[1] Clause 3 Definitions
Omit the definitions of close of ballot, close of nominations, electronic ballot, electronic vote, electronic voting system, eligible voter and Roll of the University.
Insert in alphabetical order:
close of nominations, in relation to an election, means the date and time by which nominations must be received by the Returning Officer for the election in accordance with the election rules.
election rulesmeans rules made by the Council for or with respect to matters accordance with the election rules.

Omit the clauses.
[3] Clause 9
Omit the clause. Insert instead:
9 Time of elections
Elections to elect members of the Council are to be held at the times specified in the election rules.
[4] Clause 10 Rolls
Omit “The Returning Officer is to keep the following” from clause 10 (1).
Insert instead “Before an election, the Returning Officer is to assemble the following from information held by the University”.
[5] Clauses 11–14
Omit “time specified in the notice referred to in clause 16 for” wherever occurring.
[6] Part 3 Elected members of Council
Omit Divisions 3 and 4.
