UNIVERSITY OF NEW SOUTH WALES ACT.

Act No. 49, 1961.

An Act to make further provisions as to the member­ ship of the University of New South Wales and the Council thereof and financial assistance thereto; for these purposes to amend the Technical Education and University of New South Wales Act, 1949-1958; and for purposes connected therewith. [Assented to, 4th December, 1961.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in
Parliament assembled, and by the authority of the same, as follows: —

(1) This Act may be cited as the "University of New South Wales Act, 1961".

(2) The Technical Education and New South Wales University of Technology Act, 1949, as amended by subse­ quent Acts and by this Act, may be cited as the Technical Education and University of New South Wales Act, 1949-1961.

(1) The Technical Education and University of New South Wales Act, 1949-1958, is amended—

(ii) by omitting from paragraph (d) of the same subsection the word "four" and by inserting in lieu thereof the word "five"; (hi)
(a) by inserting in subsection one of section sixteen after the word "University" where secondly occurring the words "and such superior officers within the University";

(b) (i) by omitting from subsection two of section nineteen the word "thirty-nine" and by inserting in lieu thereof the word "forty";

(iii)   by inserting in paragraph (k) of the same subsection after the word "University" the words "and such superior officers within the University";

(c) by omitting subsections one and two of section thirty-nine and by inserting in lieu thereof the follow­ ing subsections : —

(1) There shall be paid to the University in respect of the year commencing upon the first day of January, one thousand nine hundred and sixty- one, and in respect of each succeeding year, such sum as the Treasurer may determine. In making any such determination the Treasurer shall take into consideration the University's estimated expenditure requirements and income from all sources which is capable of being applied towards meeting such expenditure requirements.

(2) To enable the Treasurer to exercise and perform the powers and functions conferred on him by subsection one of this section, the University shall, in respect of the year commencing upon the first day of January, one thousand nine hundred and sixty-one, as soon as practicable after the commence­ ment of the University of New South Wales Act, 1961, and in respect of each succeeding year either before or as soon as practicable after the commence­ ment of such year, submit to the Treasurer estimates of the expenditure and income of the University for such year and such other information as the Treasurer may deem necessary.

(2) The additional person to be first nominated by the Minister for appointment pursuant to the amendment made by subparagraph (ii) of paragraph (b) of subsection one of this section shall be selected by him from the panel of names from which the four persons nominated for appointment pursuant to paragraph (d) of subsection two of section nine­ teen of the Technical Education and University of New South Wales Act, 1949-1958, for a period of four years from the first day of July, one thousand nine hundred and sixty-one, were selected. The additional member so appointed shall,

subject to the provisions of the Technical Education and : University of New South Wales Act, 1949-1961, hold office until the thirtieth day of June, one thousand nine hundred and sixty-five.

(3) The person appointed as a member of the Council of the University of New South Wales pursuant to paragraph (k) of subsection two of section nineteen of the Technical Education and University of New South Wales Act, 1949- 1958, and holding office as such immediately before the com- mencement of this Act shall be deemed to be the person appointed as such pursuant to paragraph (k) of subsection two of section nineteen of the Technical Education and University of New South Wales Act, 1949-1961.

(4) Nothing in this section shall affect the continuity of office as a member of the Council of the University of New South Wales of any person who held office as such immediately before the commencement of this Act.
