(Relating to repeal of unnecessary By-laws, to student organisations
and to the making of rules)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the University of New England Act 1989, has been pleased to approve the By-law made by the Board of Governors of the University of New England and set forth hereunder.

The Board of Governors of the University of New England, in pursuance of the University of New England Act 1989, hereby makes the By-law set forth hereunder:
Amendment of Northern Rivers College of Advanced Education
By-law
1. The Northern Rivers College of Advanced Education By-law is amended by omitting Chapters 5 and 13 and the definition of “Deputy-Chairman of the Academic Board” in clause 1.2.
Amendment of Armidale College of Advanced Education By-Law
2. The Armidale College of Advanced Education By-law is amended
by omitting Chapters 5 and 16 and by omitting the matter relating to
those Chapters from clause 3 of Chapter 1.
Amendment of Orange Agricultural College By-Law 1987
3. The Orange Agricultural College By-law 1984 is amended by
omitting Chapters 7, 8 and 17 and by omitting the matter relating to those
Chapters from clause 3.

Amendment of By-laws of University of New England
4. The By-laws of the University of New England are amended by
omitting By-laws Nos. 10, 13A, 14 and 17 and by inserting instead the

BY-LAW No. 17— Student Organisations
Rules relating to student organisations and University Unions
1. The Board of Governors may make rules regulating, or providing for the regulation, of the establishment and management of student organisations and University Unions.
BY-LAW No. 18— Rules
Making of rules
1. Each of the Vice-Chancellor, the chief executive officers and the Principal of Orange Agricultural College may, with the consent of the Board of Governors, make rules not inconsistent with the Act or these By-laws, either generally or in a specific case, regulating any matter that is, by any other By-law, required or permitted to be regulated by rule made by the Board of Governors.
Publication of rules
2. As soon as possible after a rule is made or amended, that fact and information as to where details of the new or amended rule may be obtained, must be published in an appropriate publication of the University; and:
| (a) | in the case of a rule or amendment made by the Board or a rule or amendment made by the Vice-Chancellor, be displayed in the vicinity of the office of the Vice-Chancellor, the offices of the chief executive officers of each network member and the office of the Principal of Orange Agricultural College; or |
| (b) | in the case of a rule or amendment made by the chef executive officer of a network member, be displayed in the vicinity of the office of the chief executive officer; or |
| (c) | in the case of a rule or amendment made by the Principal of Orange Agricultural College, be displayed in the vicinity of the office of the Principal. |

Commencement of rule
3. A rule takes effect on the day on which it is published in accordance with clause 2 or on such later day as may be specified in the rule.
Inconsistency between rules
4. (1) In the event of an inconsistency between the rules made by the Board and the rules made by the Vice-Chancellor, the chief executive officer of a network member or the Principal of Orange Agricultural College, the rules made by the Board prevail.
(2) In the case of an inconsistency between the rules made by the Vice-Chancellor and the rules made by the chief executive officer of a network member or the Principal of Orange Agricultural College, the rules made by the Vice-Chancellor prevail.
EXPLANATORY NOTE
The object of this By-law is to amend the By-laws of the University of New England:
(a) to repeal by-laws dealing with committees because the Board of Governors has direct authority to establish committees under the University of New England Act 1989; and (b) to repeal by-laws dealing with Pro Vice-Chancellors and the Registrar because the Board has the necessary powers under the Act to delegate authority and to confer titles on members of staff of the University; and (c) to make provision for rules to be made by the Board of Governors concerning the establishment and management of student organisations and University Unions on the various campuses; and (d) to make provision for the making, publication and commencement of rules and for the resolution of possible inconsistencies between rules made by the Board of Governors, Vice-Chancellor, chief executive officers and the Principal of Orange Agricultural College.
