HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the University of New England Act 1989, has been pleased to approve the By-law made by the Board of Governors of the University of New England and set forth hereunder.

The Board of Governors of the University of New England, in pursuance of the University of New England Act 1989, makes the following By-law:

The By-laws of the University of New England are amended by inserting after By-law No. 19 the following By-law:

BY-LAW NO. 20—STAFF CONDUCT

Rules regulating conduct of staff

1. The Board of Governors may make rules for regulating, or providing for the regulation of, the conduct of all members of staff of

the University.

Inconsistency between rules and law

2. In the event of an inconsistency between the rules made under this

By-law and the provisions of any other Act or law (including any industrial award or agreement) relating to the discipline of the persons

to whom that other Act or law applies, the provisions of that other Act
or law prevail.

EXPLANATORY NOTE

The object of the proposed By-law is to give the Board of Governors of the University of New England a broad power to make rules regulating the conduct of staff. Draft staff conduct rules are currently being developed by the University Registrars, in consultation. These draft rules will be presented for the consideration of the Board of Governors of the University.

This By-law is made under the University of New England Act 1989, including section 31 (power of Board to make By-laws) and section 32 (By-laws may empower an authority to make rules).
