    Editorial changes

    The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication.  Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.

    When preparing the authorised version of this republication amendments were not made under part 11.3 (see endnote 1).

    Uncommenced provisions and amendments

    University of Canberra (Transfer) Act 1997 (repealed)

    An Act to amend the University of Canberra Act 1989 and certain other laws, and to make certain transitional arrangements, consequent on the transfer of responsibility for the University of Canberra from the Commonwealth to the Territory

    Part 1Preliminary

    1. Short title

      This Act may be cited as the University of Canberra (Transfer) Act 1997.

    2. Definitions for Act

      In this Act:

      NoteA definition applies except so far as the contrary intention appears (see Legislation Act 2001, s 155).

      commencement means 1 December 1997.

      Principal Act means the University of Canberra Act 1989 (Cwlth) as in force immediately before commencement.

    Part 4Savings and transitional provisions

    1. Continuance in office of vice-chancellor

      The person who held office immediately before the commencement as the vice-chancellor of the University of Canberra shall, on and after the commencement, continue to hold office as the vice-chancellor and president of the University of Canberra.

    2. Existing council members

      A person who was a member of the council immediately before the commencement under an appointment or election under the Principal Act, section 11 shall, subject to the Principal Act as amended by this Act, continue to hold office as such a member for the remainder of the term of the earlier appointment or election as if he or she had, on the commencement, been appointed or elected, as the case requires, under the Principal Act, section 11 as so amended for the remainder of that term.

    3. Terms and conditions of employment of University employees

      If a person was employed by the university immediately before the commencement, this Act does not affect the terms and conditions (including any accrued entitlement to benefits) of that employment.

    4. Acting appointments

      Despite the repeal of the Principal Act, section 27 a person appointed to act under an appointment under that section that was in force immediately before the commencement shall, on and after the commencement, be taken to have been appointed to act under the University of Canberra Act 1989, section 27 as amended by this Act.

    5. Financial statements in first year

      The annual financial statements of the university under the Financial Management Act 1996, section 59 (1), as modified by this Act, relating to the calendar year in which the commencement occurs shall relate only to that part of the calendar year after the University of Canberra Act 1989 became an enactment.

    6. First annual report

      The first annual report of the university prepared after the commencement shall relate only to that part of the calendar year after the University of Canberra Act 1989 became an enactment.

    7. Application of provisions relating to statutes

      The University of Canberra Act 1989, section 42 as amended by this Act applies only in relation to statutes made on or after the commencement.

    8. Continued operation of part 5

      Despite the repeal of part 5 of the Principal Act, a provision in that part that would, but for that repeal, have continued to apply in relation to a person, matter or thing after the University of Canberra Act 1989 became an enactment shall continue to apply in relation to that person, matter or thing.

    9. Occupational health and safety

    10. A group of employees who, immediately before the commencement, was a designated work group in relation to the university under the Occupational Health and Safety (Commonwealth Employment) Act 1991 (Cwlth) shall, on and after the commencement, be taken to be a designated work group in relation to the university under the Occupational Health and Safety Act 1989.

    11. A person who, immediately before the commencement, was a health and safety representative in relation to the university under the Occupational Health and Safety (Commonwealth Employment) Act 1991 (Cwlth) shall, on and after the commencement, be taken to be a health and safety representative in relation to the university under the Occupational Health and Safety Act 1989.

    Part 5Miscellaneous

    1. Regulation-making power

      The Executive may make regulations for this Act.

      NoteRegulations must be notified, and presented to the Legislative Assembly, under the Legislation Act 2001.
