I, the Minister for Education, in pursuance of section 4 of the Universities Governing
Bodies Act 2011, make the following Order.

Explanatory note
The object of this Order is to amend the Universities Governing Bodies (University of
Newcastle) Order 2012 to provide:
| (a) | that the term of office of a member of the Council who was appointed by the Minister or the Council before the Governing body resolution took effect does not expire on 1 January 2013 unless the term of office was set to expire on or before that date, and |
| (b) | provide that the term of office for an elected (student) member of the Council is 1 year. |
This Order is made under section 4 of the Universities Governing Bodies Act 2011.

(5A) Despite subclause (3), if the term for which an existing appointed member was appointed is to expire after 1 January 2013 the member’s term of office ends on the expiry of the term for which the member was last appointed.

Omit Schedule 2 [21]. Insert instead:
[21] Clause 28 Term of office of elected members Omit clause 28 (1). Insert instead:
(1) For the purposes of section 9 (1) (c) and (d) of the Act:
(a) the prescribed term of office for a member of the Council referred to in section 8D (1) (a) of the Act is 2 years, and (b) the prescribed term of office for a member of the Council referred to in section 8D (1) (b) of the Act is 2 years, and (c) the prescribed term of office for a member of the Council referred to in section 8D (1) (c) of the Act is 1 year.
