An Act to make provision for the grant of Financial Assistance to the States in connexion with Universities

UNIVERSITIES (FINANCIAL ASSISTANCE) ACT 1963 - SECT. 1.
Short title

SECT

1. This Act may be cited as the Universities (Financial Assistance) Act 1963.*1*

UNIVERSITIES (FINANCIAL ASSISTANCE) ACT 1963 - SECT. 2.
Interpretation

SECT

2. (1) In this Act, unless the contrary intention appears- "capital expenditure" means- (a) expenditure on the purchase of land, with or without buildings, the planning, erection or alteration of a building, the development or preparation of land for building or other purposes or the installation of water, electricity and other services, other than expenditure on the alteration of a building at a cost of less than Five thousand pounds; and (b) expenditure exceeding Five thousand pounds for the purchase of, or otherwise in connexion with, a single item of equipment; "fees" means tuition, examination, matriculation and other fees payable to a University by a student enrolled at, or applying for enrolment at, the University in connexion with his course of study or attendance at the University, and including fees payable to the University in respect of the conferring of a degree or diploma, but does not include fees the payment of which is voluntary or fees payable to an organization of students; "hall of residence" means a hall, college or other establishment administered by a University at which any students of the University reside; "new institution ", in relation to a State, means a University or similar institution established in the State after the commencement of this Act and approved by the Minister as a University for the purposes of this Act; "residential college" means a residential college affiliated with, but not administered by, a University; "special research purposes ", in relation to a University, means purposes in connexion with post-graduate research in the University approved by the Commission as special research purposes, being purposes of such a special nature that, in the opinion of the Commission, they justify the provision of financial assistance under this Act additional to that provided in relation to University purposes generally; "State contributions" means moneys paid by a State to a University for university purposes, other than moneys paid in fulfilment of the conditions upon which a payment is or has been made to the State by the Commonwealth under this Act or any other Act; "the Commission" means the Australian Universities Commission established by the Australian Universities Commission Act 1959-1962; "University" means a University referred to in any of the Schedules and includes any other place of education referred to in the First or Second Schedule; "university purposes ", in relation to a University, means the general teaching and research purposes of that University in connexion with courses of study at that University, and includes external tuition for courses of study at that University and planning and other preparatory work in connexion with proposed courses of study; "year to which this Act applies" means any of the years One thousand nine hundred and sixty-four, One thousand nine hundred and sixty-five and One thousand nine hundred and sixty-six.

(1A) For the purposes of the application of this Act in relation to the year One thousand nine hundred and sixty-six, the provisions of this Act have effect as if the University of Adelaide at Bedford Park and the Flinders University of South Australia were the same University and as if a reference in this Act to the University of Adelaide at Bedford Park included a reference to the Flinders University of South Australia.

(2) In this Act, a reference to a Schedule shall be read as a reference to a Schedule to this Act.

UNIVERSITIES (FINANCIAL ASSISTANCE) ACT 1963 - SECT. 3.
Grants for recurrent expenditure

SECT

3. (1) In relation to each University specified in a Part of the First Schedule there is payable, in respect of the year to which that Part relates, to the State in which the University is situated, for the purposes of financial assistance- (a) if the sum of the fees received by the University during that year and the State contributions paid in respect of the University during that year (other than fees or State contributions used for capital expenditure or expenditure on special research purposes) is not less than the amount specified in respect of that University in the second column of that Part-the amount specified in respect of that University in the third column of that Part; or (b) in any other case-so much of the amount specified in respect of that University in the third column of that Part as bears to that amount the same proportion as the sum of those fees and the State contributions bears to the amount specified in respect of that University in the second column of that Part.

(2) Where the Minister is satisfied that a State contribution paid after the expiration of a year to which this Act applies related to university purposes in respect of that year, he may, in his discretion and with the approval of the State, direct that, for the purposes of this section, that contribution shall be treated as having been paid during that year.

(3) The financial assistance to a State under this section in relation to a University is granted on the conditions that- (a) the State will, in respect of each payment of that financial assistance and without undue delay, pay to the University an amount equal to that payment; and (b) the State will ensure that each amount so paid is applied by the University for expenditure on university purposes, not being capital expenditure or expenditure on special research purposes.

(4) In the application of this section in relation to the South Australian Institute of Technology- (a) the reference in sub-section (1) of this section to fees and State contributions shall be read as limited to fees and State contributions expended on courses of study recognized by the University of Adelaide for the purposes of courses for degrees at that University; and (b) the reference in paragraph (b) of the last preceding sub-section to university purposes shall be read as limited to purposes that are connected with courses of study referred to in the last preceding paragraph.

Salary rates

4. (1) For the purposes of financial assistance under this Act in respect of a year to which this Act applies- (a) the approved rate of basic professorial remuneration is Five thousand two hundred pounds per annum; (b) the approved rate of remuneration for an associate professor or a reader is Four thousand three hundred pounds per annum; (c) the approved maximum rate in a range of remuneration for a senior lecturer is Three thousand eight hundred pounds per annum; and (d) the approved minimum rate in a range of remuneration for a lecturer is Two thousand four hundred pounds per annum.

(2) Where the Minister is satisfied that a University, in a year to which this Act applies, has paid- (a) basic professorial remuneration at a rate higher than the rate referred to in paragraph (a) of the last preceding sub-section; (b) remuneration to associate professors or readers at a rate higher than the rate referred to in paragraph (b) of the last preceding sub-section; (c) remuneration to senior lecturers in accordance with a range of remuneration the maximum rate of which was higher than the rate referred to in paragraph (c) of the last preceding sub-section; or (d) remuneration to lecturers in accordance with a range of remuneration the minimum rate of which was higher than the rate referred to in paragraph (d) of the last preceding sub-section, the Minister may determine that the amount payable under the last preceding section in relation to that University in respect of that year shall be limited to such amount as he considers would have been the amount so payable if the approved rates referred to in the last preceding sub-section had been observed, and, in making such a determination, the Minister may have regard to the relationship between rates of remuneration referred to in this section and other rates of remuneration paid by the University.

Grants for expenditure on University building projects, &c.

5. (1) Subject to this section, if a State contribution received by a University specified in the first column of the Second Schedule in the period of three years to which this Act applies was made for the purpose of assisting the University to carry out a project of that University specified in respect of that University in the second column of that Schedule, there is payable under this section to the State in which the University is situated, for the purposes of financial assistance, an amount equal to the State contribution.

(2) The sum of the amounts payable to a State under the last preceding sub-section in relation to a University shall not exceed the sum of the amounts specified in the third column of the Second Schedule opposite to the descriptions of the projects of that University, and the respective total sums payable to a State under that sub-section in relation to the several projects of a University shall not exceed the amounts respectively specified in that column opposite to the descriptions of those several projects or such other amounts, not exceeding in all the sum of the amounts so specified, as are approved by the Commission.

(3) Where a project specified in the Second Schedule consists of, or includes, the erection, alteration or extension of a building, that project shall be deemed to include the provision of furnishings and equipment, as approved by the Commission for the purposes of this section, for that building, or for the altered parts or the extensions of that building, as the case may be.

(4) The financial assistance to a State under this section in relation to a project of a University is granted on the conditions that- (a) the State will, in respect of each payment of that financial assistance and without undue delay, pay to the University an amount equal to that payment; and (b) the State will ensure that each amount so paid to the University is applied by the University, without undue delay, towards that project.

(5) A State contribution in relation to which the State is entitled to a payment of financial assistance under this section shall not be taken into account for the purposes of section three of this Act.

(6) The Commission shall, after consultation with the Universities specified in the Second Schedule, furnish to the Minister, before the thirty-first day of May in each year to which this Act applies, a report on the progress made in the carrying out of the projects specified in that Schedule and as to the work in connexion with those projects that the respective Universities propose to have carried out during the twelve months commencing on the thirtieth day of June in that year.

UNIVERSITIES (FINANCIAL ASSISTANCE) ACT 1963 - SECT. 6.
Grants for special research purposes

SECT

6. (1) Subject to the next succeeding sub-section, where, in the period of three years to which this Act applies, a University specified in the Third Schedule incurs expenses in respect of special research purposes and applies moneys derived from a State contribution towards meeting those expenses, there is payable to the State in which the University is situated, for the purposes of financial assistance, an amount equal to- (a) one-half of those expenses; or (b) the amount derived from a State contribution that is applied towards meeting those expenses, whichever is the less.

(2) The sum of the amounts payable to a State under the last preceding sub-section in relation to a University shall not exceed the amount specified in respect of that University in the Third Schedule.

(3) The financial assistance to a State under this section in relation to any expenses of a University is granted on the conditions that- (a) the State will, in respect of each payment of that financial assistance and without undue delay, pay to the University an amount equal to that payment; and (b) the State will ensure that the University promptly discharges any outstanding liability in respect of those expenses.

(4) Except as otherwise approved by the Minister, this section does not apply in relation to expenses of a University in respect of a project referred to in the last preceding section.

UNIVERSITIES (FINANCIAL ASSISTANCE) ACT 1963 - SECT. 7.
Capital grants in respect of halls of residence and residential colleges

SECT

7. (1) Subject to this section, if- (a) during the period of three years to which this Act applies, an amount derived by a University from a State contribution is expended by the University on the purchase, erection or alteration of a building of a hall of residence, or an amount derived otherwise than in consequence of the operation of sub-section (5) of this section is expended by the body administering a residential college on the purchase, erection or alteration of a building of the college; (b) the amount so expended, and the purpose for which it is expended, have been approved, for the purposes of this section, by the Commission; and (c) the State in which the relevant University is situated requests the Commonwealth to grant financial assistance under this section in respect of that expenditure, there is payable to that State, for the purpose of financial assistance, an amount equal to the amount so expended.

(2) Subject to this section, the sum of the amounts payable under the last preceding sub-section in relation to halls of residence of, and colleges affiliated with, a particular University shall not exceed the amount specified in the Fourth Schedule in respect of that University.

(3) If, at any time during the period of three years to which this Act applies, the Minister, after consultation with the Commission, certifies that he is satisfied that the amount specified in the Fourth Schedule in respect of a University exceeds by not less than a specified amount the total of the sums that have become payable, and any further sums that may become payable, under this section to a State in relation to that University, the Commission may, subject to the approval of the Minister, determine that this section shall have effect as if- (a) an amount determined by the Commission, not exceeding the amount specified in the certificate of the Minister, were deducted from the amount specified in the Fourth Schedule in respect of that University; and (b) an amount equal to, or amounts determined by the Commission and together in the Fourth Schedule in respect of such other University or Universities as the Commission determines.

(4) The Commission may, subject to the approval of the Minister, determine that this section shall operate as if the amount or amounts specified in the Fourth Schedule in respect of a University or Universities were increased by an amount determined by the Commission but not exceeding, or by amounts so determined but not exceeding in total, One hundred and seventy-five thousand pounds, and the amount or amounts so specified in the Fourth Schedule shall, for the purposes of the preceding provisions of this section, be deemed to be increased accordingly.

(5) The financial assistance to a State under this section is granted on the condition that the State will, in respect of each payment of that financial assistance and without undue delay, pay to the University or body administering the hall of residence or residential college in relation to which that payment is made an amount equal to that payment.

UNIVERSITIES (FINANCIAL ASSISTANCE) ACT 1963 - SECT. 8.
Recurrent grants in respect of halls of residence and residential colleges

SECT

8. (1) There is payable to each State, in respect of each year to which this Act applies, for the purpose of financial assistance in relation to halls of residence and residential colleges, amounts determined in accordance with this section.

(2) The amount payable to a State under this section in respect of a year in relation to each hall of residence or residential college is the sum of- (a) Two thousand five hundred pounds; (b) an amount calculated by multiplying Fifteen pounds by the number that is the average of the maximum numbers of students resident at the hall of residence or residential college during the several terms of that year; and (c) an amount calculated by multiplying Five pounds by the number that is the average of the maximum numbers of non-resident students receiving tutorial assistance at the hall of residence or residential college during the several terms of that year.

(3) Where a hall of residence or residential college, or a part of such a hall or college, was not in use during the whole of the academic year comprised in a year to which this Act applies, the Commission may determine that the amount payable under this section in respect of that year in relation to that hall or college shall be such part only of the amount that would otherwise be payable as the Commission thinks appropriate.

(4) The financial assistance to a State under this section in relation to a hall of residence or residential college is granted on the conditions that- (a) the State will, in respect of each payment of that financial assistance and without undue delay, pay an amount equal to that payment to the University or body administering the hall of residence or residential college; and (b) the State will ensure that each amount so paid by the State is used, in the year in which it is paid, for the provision of tutorial assistance to students or for meeting administrative costs of the hall of residence or residential college.

Capital grants in respect of building projects, &c., in connexion with
teaching
hospitals

8A. (1) For the purposes of this section, the teaching hospital projects of a University are the projects in relation to a hospital or proposed hospital the name of which is specified in the first column of the Fifth Schedule under the name of that University being projects that are described in that Schedule opposite to the name of that hospital or proposed hospital and are to be carried out by the respective hospitals or proposed hospitals in accordance with arrangements with that University.

(2) Subject to this section, if a State contribution received by a University specified in the Fifth Schedule in the period of three years to which this Act applies was made for the purpose of assisting the University to meet the cost of a teaching hospital project of that University, there is payable under this section, to the State in which the University is situated, for the purposes of financial assistance, an amount equal to the State contribution.

(3) The sum of the amounts payable to a State under the last preceding sub-section in respect of the teaching hospital projects of a University in relation to a particular hospital or proposed hospital shall not exceed the sum of the amounts specified in the third column of the Fifth Schedule, under the name of that University, opposite to the descriptions of those projects.

(4) The total amount payable to a State under sub-section (2) of this section in respect of any one teaching hospital project of a University shall not exceed- (a) the amount specified in the third column of the Fifth Schedule, under the name of that University, opposite to the description of that project; or (b) subject to the last preceding sub-section, where another amount is approved by the Commission, that other amount.

(5) Where a project specified in the second column of the Fifth Schedule consists of, or includes, the erection, alteration or extension of a building, that project shall be deemed to include the provision of furnishings and equipment, as approved by the Commission for the purposes of this section, for that building, or for the altered parts or the extensions of that building, as the case may be.

(6) The Minister may, having regard to the progress made, or proposed to be made, in the carrying out of the projects, and the provision of the furnishings and equipment, referred to in this section, give directions as to the times at which, and the instalments by which, payments to a State under this section are to be made.

(7) The financial assistance to a State under this section in relation to a teaching hospital project of a University is granted on the conditions that- (a) the State will, in respect of each payment in respect of that financial assistance and without undue delay, pay to the University an amount equal to that payment; and (b) the State will ensure that each amount so paid is applied by the University, without undue delay, towards that project.

(8) A State contribution in relation to which a State is entitled to a payment of financial assistance under this section shall not be taken into account for the purposes of section three of this Act.

(9) The Commission shall, after consultation with the Universities concerned, furnish to the Minister, at such times as the Minister directs, such reports as the Minister requires on the progress made, and proposed to be made, in the carrying out of the projects specified in the second column of the Fifth Schedule.

Recurrent grants in respect of teaching hospitals

8B. (1) For the purposes of this section, the teaching hospitals of a University are the hospitals the names of which are specified in the first column of the Fifth Schedule under the name of that University.

(1A) For the purposes of this section, the teaching hospitals of a University specified in the following table include, in addition to any hospitals that are teaching hospitals of that University by virtue of the last preceding sub-section, the hospital or hospitals the name or names of which is or are specified in that table opposite to the name of that University: ------------------------------------------------------------------------------------ University Teaching Hospital ------------------------------------------------------------------------------------ University of New South Wales Prince Henry Hospital University of Melbourne Royal Children's Hospital Fairfield Hospital Monash University Royal Park Psychiatric Hospital University of Western Australia Fremantle Hospital King Edward Memorial Hospital for Women ------------------------------------------------------------------------------------ Amended by No. 91, 1966, s. 4 (2) For the purposes of this section, the appropriate costs, in relation to a teaching hospital of a University are- (a) the salaries paid to an administrative officer, to clinical supervisors, and to persons whose duties are of a secretarial nature, engaged in the administration of the teaching at that hospital of students enrolled in the Faculties of Medicine of that University and of any other University in relation to which that hospital is a teaching hospital; (b) the expenditure (other than capital expenditure) incurred by the hospital in relation to the provision of the parts of the hospital used exclusively by students referred to in the last preceding paragraph and by their teachers and of the facilities and equipment so used in connexion with those parts of the hospital; and (c) the expenditure, not including expenditure at a rate exceeding One thousand pounds per annum, incurred in the purchase of books and periodicals for the medical library of the hospital.

(3) Where a State furnishes to the Minister such information, certified to be correct by the Auditor-General of the State, as the Minister requires with respect to the State contributions in relation to the appropriate costs of the teaching hospitals of a University incurred during a period to which a Part of the Sixth Schedule relates, there is payable to the State in which the University is situated, for the purposes of financial assistance- (a) if the Minister is satisfied that the amount of the State contributions paid to that University in relation to the appropriate costs of those teaching hospitals is not less than the amount specified in respect of that University in the second column of that Part-the amount specified in respect of that University in the third column of that Part; or (b) in any other case-so much of the amount specified in respect of that University in the third column of that Part as bears to that amount the same proportion as the amount the Minister is satisfied constitutes those State contributions bears to the amount specified in respect of that University in the second column of that Part.

(4) Where the Minister is not satisfied that a reasonable amount has been expended by a teaching hospital of a University in a State in relation to the matters specified in each of paragraphs (a), (b) and (c) of sub-section (2) of this section, he may, by instrument in writing under his hand, direct that the amount of financial assistance otherwise payable to the State under this section shall be reduced by an amount specified by the Minister in the instrument.

(5) The financial assistance to a State under this section in relation to the teaching hospitals of a University is granted on the condition that the State will, in respect of each payment of that financial assistance and without undue delay, pay to the University an amount equal to that payment.

(6) A State contribution in relation to which a State is entitled to a payment of financial assistance under this section shall not be taken into account for the purposes of section three of this Act.

Termination of payments under sections 5, 7 and 8A

SECT

8C. Notwithstanding any other provision of this Act, sections 5, 7 and 8A do not authorize any payment to a State by way of financial assistance to the State after 31 December 1977.

Additional conditions

9. In addition to the conditions specified in any other provision of this Act, an amount of financial assistance to a State under this Act is granted on the conditions that- (a) if the Minister for Finance informs the Treasurer of the State that he is satisfied that the State has failed to fulfill the conditions applicable to that amount, the State will repay that amount to the Commonwealth; and (b) if that amount exceeds the amount properly payable, the State will repay the excess to the Commonwealth.

Advances

10. The Minister for Finance may, at such times as he thinks fit, make advances of such amounts as he thinks fit to a State on account of an amount that may become payable under this Act to the State, and the conditions that would be applicable to a payment of the last-mentioned amount are applicable to any such advance.

11. Payments to a State under this Act shall be made out of the Consolidated Revenue Fund, which is appropriated accordingly.
