Universities and Colleges (Higher Education Administration Charges) Act 1987, No. 2 13 BE IT ENACTED by the Queen ' s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as the Universities and Colleges (Higher Education Administration Charges) Act 1987. 2. Commencement . ( 1) Section 1 and this section shall commence on the day this Act is assented to for and on behalf of Her Majesty. (2) Except as provided by subsection ( 1), the provisions of this Act, or such of them as are specified in the Proclamation shall commence on the date or dates appointed by Proclamation. 3. Arrangement . This Act is arranged in Parts as follows:- PART I-PRELIMINARY ( ss. 1-3); PART II-AMENDMENT OF UNIVERSITY OF QUEENSLAND ACT (ss. 4-5); PART III-AMENDMENT OF GRIFFITH UNIVERSITY ACT (ss. 6-7); PART IV-AMENDMENT OF JAMES COOK. UNIVERSITY OF NORTH QUEENSLAND ACT (ss. 8-10); PART V-AMENDMENT OF EDUCATION ACT (ss. 11-13); PART VI-REFUND OF HIGHER EDUCATION ADMINISTRATION CHARGE ( ss. 14-15). PART II-AMENDMENT OF UNIVERSITY OF QUEENSLAND ACT 4. Citation. (I) In this Part the University of Queensland Act 1965- 1984 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the University of Queensland Act 1965-1987. 5. Amendment of s. 34. Statutes . Section 34 of the Principal Act is amended in subsection (1) by inserting after paragraph (xiii) the following paragraph:- "(xiiia) The imposition and collection in respect of each year of a higher education administration charge in accordance with the States Grants (Tertiary EducationAssistance) Act 1984 of the Commonwealth, as amended for the time being, or any Act passed in substitution for that Act;". PART III-AMENDMENT OF GRIFFITH UNIVERSITY ACT 6. Citation . ( 1) In this Part the Griffith University Act 1971-1984 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the GriffithUniversity Act 1971-1987.

Section 36 of the Principal Act is amended in subsection (1) by inserting after paragraph (xiii) the following paragraph:- "(xiiia) the imposition and collection in respect of each year of a higher education administration charge in accordance with the States Grants (Tertiary EducationAssistance) Act 1984 of the Commonwealth, as amended for the time being, or any Act passed in substitution for that Act;". PART IV-AMENDMENT OF JAMES COOK UNIVERSITY OF NORTH QUEENSLAND ACT 8. Citation . ( 1) In this Part the James Cook University of NorthQueenslandAct 1970-1984 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the James Cook University of North Queensland Act 1970-1987. 9. Amendment of s. 8. Disqualifications from office. Section 8 of the Principal Act is amended in subsection (2) by omitting the words "paragraphs (d), (e) or (f)" and substituting the words "paragraphs (d), (e), (ea), (f), (fa) or (g)". 10. Amendment of s. 39. Statutes . Section 39 of the Principal Act is amended in subsection (1) by- (a) inserting after paragraph (xiii) the following paragraph:- "(xiiia) the imposition and collection in respect of each year of a higher education administration charge in accordance with the States Grants (Tertiary EducationAssistance) Act 1984 of the Commonwealth, as amended for the time being, or any Act passed in substitution for that Act; "; (b) inserting after paragraph (xv) the following paragraph:- "(xva) the development, promotion and marketing of inventions and the acquisition, control and disposal of patents and patent rights, by the University or by a person on behalf of the University;". PART V-AMENDMENT OF EDUCATION ACT 11. Citation . ( 1) In this Part the Education Act 1964-1984 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the EducationAct 1964-1987.

Minister to provide for running of colleges, etc. Section 35 of the Principal Act is amended by inserting after paragraph (d) the following paragraph:- "(da) the imposition and collection in respect of each year of a higher education administration charge in accordance with the States Grants (Tertiary EducationAssistance) Act 1984 of the Commonwealth, as amended for the time being, or any Act passed in substitution for that Act;". 13. Amendment of s. 62c. Council may make by-laws. Section 62c of the Principal Act is amended in subsection (1) by inserting after paragraph (i) the following paragraph:- "(ia) the imposition and collection in respect of each year of a higher education administration charge in accordance with the States Grants (Tertiary EducationAssistance) Act 1984 of the Commonwealth, as amended for the time being, or any Act passed in substitution for that Act;". PART VI-REFUND OF HIGHER EDUCATION ADMINISTRATION CHARGE 14. Interpretation . In this Part the expression "higher education administration charge" means a charge imposed by the statutes, rules or by-laws made under the Acts referred to in sections 4 (2), 6 (2), 8 (2) and 11 (2). 15. R efund of higher education administration charge. Notwithstanding the provisions of the statutes, rules or by-laws made under the Acts referred to in sections 4 (2), 6 (2), 8 (2) and 11 (2), a person who in any academic year terminates his enrolment at a university or college and enrols at any other university or college shall be entitled to a refund from the firstmentioned university or college of an amount that bears to the higher education administration charge paid by him to the firstmentioned university or college the same proportion that the balance of the academic year remaining at the termination of his enrolment bears to that academic year, within 30 days of such termination. Such amount may be recovered by that person by action in a court of competent jurisdiction as for a debt due and owing to him.
