COMMISSIONER LEWIN

MELBOURNE, 5 DECEMBER 2011

Good faith bargaining - proposals - responses - reasons - obligation to meet and confer - deferral of ballot

[1] An application has been made by United Voice pursuant to s.229 of the Fair Work Act 2009 (the Act) for a bargaining order. United Voice is a bargaining representative for a proposed enterprise agreement between MSS Security Pty Ltd (MSS Security) and its employees.

[2] I have decided that the requirements of s.230 of the Act are met in relation to the agreement and I am satisfied that it is reasonable in all the circumstances to make a bargaining order.

[3] I shall publish my reasons for this decision in due course.
