Proposed protected action ballot by employees of Assetlink Services Pty Ltd.

[1] This decision concerns an application made pursuant to s.437 of the Fair Work Act 2009 (FW Act) by United Voice (UV), for a protected action ballot order in relation to certain employees of Assetlink Services Pty Ltd.

[2] This matter was listed for hearing today. The application was not opposed. I have relied on the witness statement of Emily McMillan, Industrial Officer, which was filed on 10 November 2011. I have also had regard to the matters considered in my decision 1 of 26 October 2011, which concerned a similar application in respect to other employees and employers in the contract cleaning industry. I am satisfied that the requirements in s.443(1)(a) and (b) have been met and that, accordingly, an order must be made.

[3] An order 2 will issue at the same time as this decision.
