1. The applicant seeks special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of New South Wales (White JA, Harrison JA and Basten A-JA), which dismissed an appeal from a judgment of the Supreme Court of New South Wales (Peden J).

2. In relation to the applicant's first and second special leave questions, the proposed appeal presents as an inappropriate vehicle to consider the questions of principle sought to be raised. In relation to the applicant's third special leave question, there is no reason to doubt the correctness of the decision of the Court of Appeal.

3. Special leave to appeal is refused with costs.
