DECISION OF A DELEGATE OF THE REGISTRAR OF TRADE MARKS, WITH REASONS

Re:      Opposition by ESPRIT INTERNATIONAL to the registration of trade mark
           Application number 598177 in the name of UNION KNITTING MILLS PTY.
           LTD.

On 30 November 1998, I issued a decision in relation to the above opposition in which I allowed the trade mark applicant one month from the date of my decision to have the second trade mark in the series deleted from the application, so that the application may be registered for the trade mark ESLEEP in the plain block type. 

Application number 598177 has now been amended to conform with the above requirement.  Consequently, subject to any appeal from my decision, this application should proceed to registration.

I dealt with the matter of costs in my previous decision.
