The Uniform Rules Committee has made the following rules of court under the Civil Procedure

Explanatory note

The object of these Rules is to provide that a garnishee order does not operate to attach to a debt if the debt is an amount of less than $20 standing to the credit of the judgment debtor in a financial institution.

1      Name of Rules

These Rules are the Uniform Civil Procedure Rules (Amendment No 66) 2014.

2      Commencement

These Rules commence on the day on which they are published on the NSW legislation website.

3 Amendment of Uniform Civil Procedure Rules 2005

Rule 39.39A

Insert after rule 39.39:

39.39A When garnishee not obligated to pay amount to judgment creditor

A garnishee order does not operate to attach to a debt if the debt is an amount of less than $20 standing to the credit of the judgment debtor in a financial institution.
