The Uniform Rules Committee has made the following rules of court under the Civil Procedure

Explanatory note

The object of these Rules is to amend rule 6.2 of the Uniform Civil Procedure Rules 2005 to extend (from one month to 6 months) the period for which a statement of claim seeking relief in relation only to a debt or other liquidated claim remains valid for service after the date on which it is filed.

1      Name of Rules

These Rules are the Uniform Civil Procedure Rules (Amendment No 64) 2014.

2      Commencement

These Rules commence on the day on which they are published on the NSW legislation website.

3 Amendment of Uniform Civil Procedure Rules 2005

Rule 6.2 How proceedings commenced

Omit rule 6.2 (4) (b) (i) and (ii). Insert instead:

(i)      for 6 months after the date on which it is filed:

(A) if it is a statement of claim seeking relief in relation
only to a debt or other liquidated claim, or
(B) if the defendant (or at least one of the defendants) is
to be served outside New South Wales, or

(ii)      for one month after the date on which it is filed, in any other case.
