The Uniform Rules Committee has made the following rules of court under the Civil
Procedure Act 2005.

Explanatory note
The object of these Rules is to amend rule 4.2 of the Uniform Civil Procedure Rules 2005 to require originating processes and other documents filed on behalf of a person to state the email address of the solicitor representing the person or, if the person has no solicitor, the person’s email address.

1 Name of Rules
These Rules are the Uniform Civil Procedure Rules (Amendment No 60)
2013.
2 Commencement
These Rules commence on the day on which they are published on the
NSW legislation website.

[1] Rule 4.2 Documents to be filed to contain certain information
Insert after rule 4.2 (1) (g):
(g1) the email address of the party’s solicitor (if the party has engaged a solicitor to act as the party’s legal representative) or the email address of the party (if a solicitor has not been engaged),

Omit the note at the end of the subrule. Insert instead:
Note 1. A solicitor named on the originating process pursuant to paragraph (e1) is thereby the solicitor on the record in relation to the party on whose behalf the process is filed.
Note 2. In relation to paragraph (g1), if a party does not have an email address, this fact must be stated.
[3] Rule 4.2 (2) (f)
Insert after rule 4.2 (2) (e):
(f) the email address of the person’s solicitor (if the person has engaged a solicitor to act as the person’s legal representative) or the email address of the person (if a solicitor has not been engaged).

Insert after note 2 at the end of the subrule:
Note 3. In relation to paragraph (f), if a person does not have an email address, this fact must be stated.
[5] Rule 4.2 (3)
Omit “DX address, fax number or electronic mail address”.
Insert instead “DX address or fax number”.
