(Amendment No 57) 2013

The Uniform Rules Committee has made the following rules of court under the Civil

Procedure Act 2005.

Explanatory note

The object of these Rules is to allow a pleading to include a claim for the cost of hiring a replacement car as a consequence of damage alleged to have been sustained as the result of the negligence of the defendant.

1      Name of Rule

These Rules are the Uniform Civil Procedure Rules (Amendment No 57)
2013.

2      Commencement

These Rules commence on the day on which they are published on the
NSW legislation website.

[1]      Rule 14.13 Pleading not to claim an amount for unliquidated damages

Omit “in the District Court or” from rule 14.13 (2).

[2]      Rule 14.13 (2) (a) (iv)

Insert at the end of rule 14.13 (2) (a) (iii):

, or

(iv)      the cost of hiring a replacement car,

Omit “or towing”. Insert instead “, towing or cost of hiring”.
