The Uniform Rules Committee has made the following rules of court under the Civil

Procedure Act 2005.

Explanatory note

The object of these Rules is to prescribe a Supreme Court registrar as an officer of the Supreme Court before whom an examination on oath of certain persons may be conducted, being persons the subject of an application for a confiscation order under the Criminal Assets Recovery Act 1990 and spouses or de facto partners of such persons.

1      Name of Rules

These Rules are the Uniform Civil Procedure Rules (Amendment No 52)
2012.

2      Commencement

These Rules commence on the day on which they are published on the
NSW legislation website.

3 Amendment of Uniform Civil Procedure Rules 2005

Schedule 10 Provisions regarding procedure under particular legislation

Omit clause 2 of the matter relating to the Criminal Assets Recovery Act

1990 in Part 1 of the Schedule.

Insert instead:

2      Prescribed officer: sections 12 and 31D

For the purposes of sections 12 (1) (b) and (b1) and 31D (1) (a) and (b) of the Act, a registrar is a prescribed officer of the Supreme Court.
