The Uniform Rules Committee has made the following rules of court under the Civil
Procedure Act 2005.

Explanatory note
Following the approval of Forms 26A and 27A for subpoenas, the notice and declaration that an issuing party was previously required to attach to a subpoena for use by an addressee now form part of the approved form for a subpoena.
The object of these Rules is to amend rule 33.10 of the Uniform Civil Procedure Rules 2005 to recognise that the notice and declaration are no longer required to be attached to a subpoena because they form part of the subpoena.

1 Name of Rules
These Rules are the Uniform Civil Procedure Rules (Amendment No 50)
2011.
2 Commencement
These Rules commence on the day on which they are published on the
NSW legislation website.
3 Amendment of Uniform Civil Procedure Rules 2005
(1) Rule 33.10 Disposal of documents and things produced Omit rule 33.10 (3).
(2) Rule 33.10 (4) Omit the subrule. Insert instead:
(4) The addressee must complete the notice and declaration in the subpoena and produce the subpoena (or copy of the subpoena) with the documents produced to the court under the subpoena.
