The Uniform Rules Committee has made the following rules of court under the Civil

Procedure Act 2005.

Explanatory note

The object of these Rules is to clarify that a person may apply for an order for assessed costs in the Supreme Court where the total amount of the unpaid costs that are included in more than one cost assessor’s certificate filed together under rule 36.10 (1) and (2) of the Uniform Civil Procedure Rules 2005 exceed $150,000.

These Rules are the Uniform Civil Procedure Rules (Amendment No 43)
2011.

2      Commencement

These Rules commence on the day on which they are published on the
NSW legislation website.

3 Amendment of Uniform Civil Procedure Rules 2005

Rule 42.31 Recovery of assessed costs in Supreme Court

Insert at the end of the rule:

(5) In this rule, a reference to a certificate includes a number
of certificates filed together under rule 36.10 (1) and (2).
