The Uniform Rules Committee has made the following rules of court under the Civil

Procedure Act 2005.

Explanatory note

The object of these Rules is to amend the Uniform Civil Procedure Rules 2005 to update references to provisions of the Electronic Transactions Act 2000 that were renumbered by the Electronic Transactions Amendment Act 2010.

1      Name of Rules

These Rules are the Uniform Civil Procedure Rules (Amendment No 38)
2010.

2      Commencement

These Rules commence on the day on which they are published on the
NSW legislation website.

3      Amendment of Uniform Civil Procedures Rules 2005

(1) Rule 3.1 Definitions

Omit “section 14B of” from rule 3.1 (1).

Insert instead “clause 2 of Schedule 1 to”.

(2) Rule 3.2 Application of Part
Omit “section 14C of” from rule 3.2.
Insert instead “clause 3 of Schedule 1 to”.
(3) Rules 3.4 and 3.7
Omit “section 14E of” from rules 3.4 (2A) (b) and 3.7 (3) wherever occurring.
Insert instead “clause 5 of Schedule 1 to”.
(4) Rule 3.9 Use of ECM system in business conducted in the absence of
the public
Omit “section 14I of” from rules 3.9 (1).
Insert instead “clause 9 of Schedule 1 to”.
(5) Rule 10.5 The various methods of service
Omit “section 14M of” from the note.
Insert instead “clause 13 of Schedule 1 to”.
