The Uniform Rules Committee has made the following rules of court under the Civil

Procedure Act 2005.

Explanatory note

The object of these Rules is to amend the Uniform Civil Procedure Rules 2005 to require a party who files a defence electronically in proceedings in the Local Court to serve the defence on the other parties.

1      Name of Rules

These Rules are the Uniform Civil Procedure Rules (Amendment No 35)
2010.

2      Commencement

These Rules commence on the day on which they are published on the
NSW legislation website.

3 Amendment of Uniform Civil Procedure Rules 2005

Rule 10.1 Service of filed document

Insert at the end of rule 10.1:

(3) Despite subrule (2), a defence that is filed in proceedings in the Local Court by means of the ECM system (within the meaning of Part 3) must be served on the other parties by the party that filed the defence rather than by an officer of the Local Court.
