The Uniform Rules Committee has made the following rules of court under the Civil

Procedure Act 2005.

Explanatory note
The object of these Rules is to amend the Uniform Civil Procedure Rules 2005 as follows:

(a)

to repeal a rule dealing with the powers of the judicial registrar of the District Court as such matters are already dealt with in the District Court Rules 1973,

1      Name of Rules

These Rules are the Uniform Civil Procedure Rules (Amendment No 33)
2010.

2      Commencement

These Rules commence on 1 July 2010 and are required to be published on the NSW legislation website.

[1]      Rule 1.10 Powers of the judicial registrar

Omit the rule.

[2]      Rule 6.12 Relief claimed

Omit rule 6.12 (8) (as amended by Schedule 1 [1] to the Uniform Civil
Procedure Rules (Amendment No 32) 2010).
Insert instead:
(8) If no rate of interest is specified under subrule (7) (b), the rate at
which interest is claimed is taken to be:
(a) in respect of the period from 1 January to 30 June in any year—the rate that is 4% above the cash rate last published by the Reserve Bank of Australia before that period commenced, and
